hW $ n4M// HIGHLIGHTS OF WEEKLY INFORMATION REPORT C g } I Week Ending September 17, 1982 4 Beaver Valley, Unit 1 The licensee is investigating a recent occurrence involving a pilot operat,ed relief valve that lifted for a few seconds while the plant was heating up from prior shutdown. The PORY resented properly and there was no release to the environment. j Nine Mile Point Ultrasonic (UT) examination of the Emergency Condenser (ECS) and Shutdown Cooling Systems (SCS) recently showed preliminary indication of cracks in twelve of thirteen welds. Results of further testing may require the licensee to expand the scope of piping replacement to include safety-related piping other than primary coolant piping. Susquehanna, Unit 1 On September 10, 1982, the reactor achieved initial criticality. Pebble Springs Portland General Electric Company infomed NRR that it was proceeding with plans to teminate the Pebble Springs application. Final plans' are expected by the first of October. Uranium Recovery Reg'ionalization The Uranium Recovery Field Office will be established in Denver, Colorado on i October 1,1982. Field Office staff will be in the W111ste Building until relocated. Spent Fuel Storage NRC met with Virginia Electric and Power Company (VEPCO) to discuss three options to store spent fuel from the Surry facility:

1) Transshipment to and storage at North Anna site;
2) A water pool type independent spent fuel storage installation (ISFSI) i at Surry site with application expected in June 1983; and
3) A dry cask type ISFSI at Surry site with application expected in October 1982.

VEPCO prefers tne first option. 1 LOFT On September 20-21, 1982, a meeting will be held at the OECD/ Nuclear Energy Agency Heqdquarters to decide whether or not to proceed with DOE's proposal for a LOFT International Consortium. SEP 171H2 l 1

Under Contract No. NRC-03-79-118 The Franklin Institute is providing l assistance in support of NRR licensing actions. The contractor has I notified the Contracting Officer (CO) that Work Assignment 13, " Review of Licensee's Resolution of Outstanding Issues from NRC Equipment Environment Qualification Safety Evaluation Reports," will be deleyed beyond 9/30/82 because the volume of documentation to be reviewed greatly exceeds the amount assumed in establishing the original manpower and cost estimate. As a result of a September 10, 1982 meeting between the contractor and NRC (NRR and DC), the contractor was l requested to furnish alternative approaches for completion of this assignment including detailed cost estimates for each of the alternatives presented no ] later than September 17, 1982. Upon receipt of the contractor's proposals, DC will meet with NRR to determine'the appropriate course of action to insure satisfactory completion of the work and timely issuance of the required SER. 2. On September 15, 1982, DC participated with NRR and I&E representatives in a meeting held in Headquarters with representatives from each of the Regional Offices to discuss the procurement process and' Regional assumption of work being per* formed under existing Headquarters technical assistance contracts. Mary Jo Mattia, DC, provided an overview of the procurement process, the importance of Advance Procurement Plans and existing Basic Ordering Agreements that could be utilized to meet the Regions contractual needs. Tim Hagan, DC, discussed the contracts in support of NRR's licensing action programs and the utilization of such contracts by the Regions. Bernie Grenier, NRR, and Howard Rose, I&E, discussed the utilization of existing DOE Laboratory Agreements and the procedures for use of such agreements. In addition, a review of I&E existing contracts was also conducted. f DIVISION OF SECURITY l ITEMS OF INTEREST l Week Ending September 17, 1982 SECY-82-330, "NRC Personnel Security Procram Modifications SEC was advised that the Commission (with all Comissioners agreeing) approved l l theit recomended modifications to the NRC Personnel Security Program, subject to the addition that the Comissioners' assistants having access to intelli-l gence information will be subject to a full field investigation by the FBI. SEC will start implementing these modifications which will, among other items, result in revised position sensitivity critieria and in revised levels of clear-ance for NRC employees. SEC will shortly be contacting Headquarters and Regional Office personnel regarding these modifications. l Aporoval of NRC-RDRM-1 The EDO approved, on September 14, 1982, NRC-RDP.M-1, "NRC Classification Guide for Infncmation Dealing with the Release and Dispersion of Radioactive Material." P i i 0FFICE OF NUCLEAR REACTOR REGULATION ITEMS OF INTEREST Week Ending September 17, 1982 Eeaver Valley Unit 1 l While heating up from prior shutdown, with RCS pressure at about 350 psi and l Tavg at 260'F, a PORV lifted (low set point is 350 psi)_ This occurred at i 4:00 p.m., September 8,1982. At that time, the pressunzer relief tank (PRT) was being purged with water as part of the procedre to establish an blanket. With the PRT being water solid, the ruptune disc was blown out i N 2by the sudden increase in pressure due to PORY venting. The RCS pressure dropped to 325 psi. The FRT had been filled with primary grade water at the time of the incident. Centainment integrity had been established prior to stantup. There wa s, thus, no release to the environment. l The licensee reported that the PORV stayed open for abac "a couple o# seconds." The pressurizer was filled to 30% water and, therefore, the l brief venting through the PORY should involve only sters. The PORV resented l properly af ter the lifting. l The licensee beli[ees the PORV lifted on a spurious sigal. Investigation l cf the cause is c going. Prior to the incident, the'ltensee had requested Westinghouse to s~udy the feasibility of raising the 106 PORY setpoint to j about 400 psi. Tnis study is still in process. 4 ) 5 i A primary system gas sample was taken from the center control rod drive mechanism, indicating that the gas generated in the core was not collecting in explosive concentrations. The sample indicated that hydrogen gas was being released, but there did not appear to be any release of oxygen to support combustion. Based on the latest measurements, the gas generation l rate in the reactor vessel was ' calculated to be less than 0.02 cubic foot per day. Three reactor building entries are scheduled for next week. Decontamination i inside the reactor building will be the predominant work activity. 4 EPICOR II Prefilter Shipment. The licensee is sampling and inerting the PF-6 waste liner. PF-6, wnien contains approximately 170 curies of fission products, will be placed in an existing SN-1 type B shipping cask (designed to withstand transportatior; accidents) to determine if this relatively low curie liner can meet the DOT /NRC shipping dose rate requirements. This demonstration is expected to be completed by the end of September 1982. 5. Reactor Buildine and Incore Thermocouple Temperatures. Since mid-August 1952, Ine reportec average incere thermocouple reacings have dropped from a maximum of 127'T to the current level of 118'F. The maximum reported incore thermoccuole dropped from 144*F to 136*F, and the RCS loop temperatures i showed correspending decreases. These decreasing trends in temperatures are expected, primarily due to normal variations in the ambient temperature insice the reactor building. -4 s. Past Meetin; On Friday, September 17, 1982, Mr. Demetrios Basdekas spoke to the Susquehanna Valley Alliance (SVA) about the " Risk of Core Melt". Lake Barrett attended the meeting and was requested by the SVA not to respond or comment on statements made during the meeting. Future Feetings 1. On Wednesday, September 22, 1982, Lake Barrett will meet with the Concerned Mothers of Middletown to discuss the cleanup efforts for TMI Unit 2 and the restart of Unit 1. 2. On Tuescay, September 28, 1982, Lake H. Barrett will participate in a public meeting sponsored by the Hershey League of Women Voters to discuss TMI Unit 2 cleanup issues. l l 3. 0FFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Endino September 17, 1982 A".sX, Inc., Parkersburo, West Viroinia The Amax site near Parkersburg, West Virginia, was visited by W. A. Nixon on September 14, 1982. Amax has ccmpleted the movement of all contaminated material to the storage mound. The contaminated material has been covered with 6" of soil and the clay cap is being put in place. The cap should be completed by the end of September and all stabilization activities, including fencing and seeding of the storage site, should be completed by November 1, 1982. General Electric Co. (GE) Wilminoton, North Carolina On September 7, 1982, members of the NMSS staff met with Region 11 personnel to discuss a draf t of a proposed license renewal for GE's LWR fuel fabrication facility in Wilmington, North Carolina. On September 8, representatives from NMSS and Region 11 met with officials of the State of North Carolina to discuss proposed NRC monitoring requirements for non-radiological contaminants in GE's gaseous and liquid effluents and the groundwater surrounding GE's lagoon system. The purpose of the meeting was to determine if the NRC imposed conditions were compatible with the State's regulatory requirements so that if the State should desire to assume regulatory responsibility over non-radiological releases the conditions could be assumed verbatim in a State permit. As a result of the meeting several conditions were deleted and others were modified to address the State's comments. On September 8 and on September 9 the members of the HMSS and Region II staff met with GE to discuss the questions and comments the staff had generated as a result of the GE renewal application review and the staff's proposed course of action on the renewal application. Spent Fuel Storace On September 13, 1982 NRC staff met with Virginia Electric and Power Company (VEPCO) to discuss VEPCO's preparation of a license application to store spent fuel in a water pool type independent spent fuel storage installation to be located at its Surry site. An application from VEPC0 is expected about June 1983. This application would be in addition to VEPCO's application for transshipment and storage of Surry spent fuel at its North Anna facility, submitted to NRR, and the application to be filed in October 1982 to store Surry spent fuel in an onsite dry cask type ISFSI. John J. Linehan will testify on behalf of the NRC. Uranium Recovery Field Office The Uranium Recovery Field Office will be established 'in Denver, Colorado en October 1, 1982. Until staff is relocated, the Field Office staff will be located in the Willste Building, Silver Spring, MD. Peetin with Energy Fuels Nuclear, Inc. On September 13, 1982, a revised reclamation plan and new breakdown of reclamation costs were presented to the WMUR staff by Energy Fuels Nuclear, Inc. These revisions have affected the avenues available to EFN for surety arrangements. Following the staff's review of these new surety options, it is likely that EFN will establish an acceptable surety and their current hearing request regarding the surety requirements of their license (SUA-135E) will become moot. 4 stp 1 7 1952 ENCLOSURE C I

Semiscale System upgrade to MOD-2B has slipped by about one-week. The pressurizer upgrade involves replacing the present pressurizer with a unit which is properly scaled in height, heater configuration, and surge line. The new pressurizer will be tall and narrow. As a result, heat losses will be reduced by a sleeved shell design. Construction of the shell has proven to be more time consuming than anticipated. All other work is on schedule. j B&W Experimental Program A meeting with the B&W Owners is. scheduled for September 16,19B2 in Washington, D.C. to discuss the possibility of a cooperative j program. NRC and the B&W Owners will present their interest in i obtaining data in an integral system having a geometry simular to a B&W plant. This will be followed by a discussion of a possible i cooperative program, areas of common interest, and how to proceed. i Workshop on COMMIX-1 A Code at ANL September 8-15,1982 A three day workshop on the C0KMIX-1 A three-dimensional transient thermal hydraulics code was held at Argonne National Laboratory on September 8-10, 1982. Total atten-dance was 67 with 42 individuals from outside ANL. Representatives from W. Germany, France, U.K. and Japan attended. During the workshop three problems were set up and analysed. Users such as General Atomic, General Electric, and Babcock and Wilcox Co (B&W) made presentations on their applications. There was a great deal of discussion on the numerical diffusion problem and how to solve it. EPRI has awarded B&W a contract to investigate the problems and recommend improvements in numerics. At present no Eulerian code has a satisfactory solution. Turbulence modeling was also discussed. In general the improved version of C0KMIX-1 A with fully implicit numerics and mass rebalance was well received. Generally a turbulence model is not needed when the porosity treatment is used j since it is already included in the fomulation. For other problems the single i equation k model in COMMIX is probably adequate. A version with two equation K-E model is operational but has not been released. 4 SEP 171922 ENCLOSURE E I

i PBF The first severe fuel damage (SFD) test in the PBF at INEL was scheduled for September 24. We expect this date to slip about a week. A system operation test to demonstrate that the recently installed experiment cooling system is functioning properly has shown a problem. Also, the in-pile tube closure head is leaking at one of the instrumentation pene-tration seals. The SFD experiment consists of 3 days steady state irradiation followed by 8 days cooling followed by the 2 hour transient test which is expected to reach a peak fuel temperature of 2400K. COBRA / TRAC J. Han visited PNL on September 8 and 9, 1982 to review COBRA / TRAC best-estimate calculations for a UHI-equipped PWR under large-break LOCA. The result indicates that the upper head water injection into the core is effective in core cooling. The calculated peak clad te perature is 11500F and the whole core is quenched at 14 seconds af ter the LOCA initiation. Ptil is completing another calculation using evaluation,model conditions with higher decay heat.and rod peaking factors. Results of the best-estimate and the evaluation-model calculations will be compared in the upcoming Tenth Water Reactor Safety Research Information Meeting. During Mr. Crews' stay in Brazil, he will advise the CNEN on activities related to the implementation of a resident inspector program. Retransfer of Separated Plutonium from France to Japan On September 14, DOE, NRC (IP and NMSS), ACDA and State met with a Japanese i delegation f rom the Power Reactor and Nuclear Fuel Development Corporation (PNC) to discus 5 again arrangements for the transportation of 105 kilograms of separated plutonium proposed to be transferred from France to Japan. (ine quantity was incorrectly stated as 105 tonnes in the August 27 weekly.) The Japarese expressed a desire to have the request processed on an urgent basis since tne material will be needed by early January 1983. DOE assured the Japanese that the request would be processed in a timely manner after the additional information which the Japanese have agreed to provide is received. NRC review of the program may have a significant impact on the length of the plant's present outage. San Onofre, Unit 2 At the request of the licensee, NRC amended Unit 2's operating license to delay the post-accident sampling system (PASS) operability to January 1,1983. A condition of the license was that the PASS had to be operable prior to exceeding j 5% power. Hardware modifications for making the PASS operable are causing the delay. Susouehanna, Unit i On Septemoer 22, a brief fire occurred in the ESW switchgear at the plant due to a wire accidently dropped across a breaker during modifications to the ESW l system. Damage appears to be limited to the affected breaker. 1 Palo Verde, Unit 3 On September 22, 1952, a rebar curtain gave way in the Fuel Handling Building killing a Bechtel Power Corporation iron worker and injuring four others, two of which required hospitalization. Construction Assessment Team j During September 20-24, 1982, initial CAT inspection activities were conducted at the TVA-Bellefonte site near Scottsboro, Alabama. 1 Ouality Assurance An incecendent assessment of safety-related welds at WPPSS, Unit 2 will be ~ l l oerfor ed during the week of September 27th through a joint effort with contractors, l Regi on and Region V staff. San Onofre 2 j On September 11, 1982, the San Onofre Unit 2 licensee notified the NRC staff i that the post-accident sampling system (PASS) could not be declared operable until several hardware modifications have been made. The licensee estimates that these changes will take about 3 1/2 months. Condition 2.C.(19)i of the San Onofre 2 Operating License requires that the PASS be operable prior to exceeding 5% power. The plant is expected to be ready to exceed Si, pcwer this a sk. By letter dated September 11,1952, the licensee requested that the San Onofre Unit 2 Operating License be amended to change the date for PASS-operability to January 1,1933. Amendment No. 8 which changed the date for 4 operability was issued September 17, 1982. Arkansas Nuclear One Unit No. 1 Arkansas Power & Light Company had planned a chemical cleaning of the "A" 1 steam generator during the next refueling outage (November 1982) to remove the buildup of debris at the orifices of the support plates. However, as a result of replacing the main feedwater nozzles in the "A" OTSG in March 1982, the '"A" OTSG is operating at relatively normal levels and, therefore, AP&L has decided not to perform chemical cleaning of the "A" OTSG durir.g the next refueling outage. i ENCLOSURE 5 SE? 2 41932

4 l ' j Fire in ESW Switchcear at Susouchanna, Unit 1 At approximately 9:35 a.m. on September 22, a fire occurred in the ESW switchgear at Susquehanna due to a wire accidently being dropped across a breaker during modifications to the ESW system. The fire was almost immediately put out, Damage appears to be limited to the affected breaker. An ALERT was initially declared and was downgraded to an UNUSUAL EVENT at approximately 10:42 a.m. The reactor was operating at 2-3% power with low power testing in progress. The plant is continuing to operate under a 12-hour limiting condition of operation.(LCO). BWR Recirculation System pioino Surveil'1ance A reeting has been scheduled with all BWR Owners on September 27,1982 to discuss staff intentions regarding large line cracks in BWRs. Submerced Deminerali:er System (SDS). Staging of 30,500 gallons of reactor bulicing sump water in tne SDS tank farm began on September 24, and was completed on September 27, 1982. Processing of this water (Batch No. 36) is scheduled to begin on September 27 and to be completed on October 2, 1982. 2. EPICOR II. The EPICOR 11 system, presently shutdown because no water is reacy for processing, is scheduled to be reactivated on September 29, 1982 and te begin processing SDS effluent (Batch No. 36), 3. Reacter Buildino Entries. Reactor building entries were conducted on Monday, hecnescay, anc Fricay, Septerter 20, 22, anc 24, 1982. Decontamination of the reaC*cr building dome Continued during the entries this week. The dome decontamination is the first phase of an ongoing decontamination effort to reduce loose surface contamination on exposed reactor building surfaces. High pressure, hot water spray will be used as the basic decontamination technique in the reactor building during subsequent phases of the decontamination. One to two hundred thousand gallons of previously processed I water will be used. The water will collect in the reactor building sump for reprocessing through the Submerged Deminerali:er System. Follo,ving the water soray, selected surfaces will be covered with a strippable coating to control ccntamination and to reduce airborne activity. the dectntaminatien will be performed over a period of several months. It is anticipatec that three entries per week will be conducted during this period. It is anticipated that the reactor building purge will be operated almost centinucusly during this period to maintain building temperatures at about 60*F to m1nimize heat stress on personnel working insice. Continuous ccera* ion cf the purge is not expected to significantly increase offsite releases. Radioactive particulate material in the purge air flow are effectively removed by passing inrough three sequential sets of filters. The first filter, called a roughing filter, is similar to a home furnace filter: it keeps the two downstream filters physically clean. The second and third filters are called HEPA (high efficiency particulate air) filters: they remcve essentially all of the remaining particulate material in the air flow. (Two HEPA filters are used to provice system redundancy.) To date, there has been no incication cf increased particulate releases during reactor building entry purges.

. Krypton 55 has been reduced to below detectable limits inside the reactor building; its environmental impact resulting from a continuous purge is insignificant. Tritium releases are expected to increase as relatively dry ambient ' air is cycled through the reactor building at approximately 25,000 cubic feet per minute by the purge system. The moisture content of the air will be increased by evaporation of the sump and the high pressure spray water (in which the tritium content will be approximately one microcurie per milliliter). The tritiated vapor will be released to the environment with the purge discharge. It is estimated that approximately 10 curies of tritium will be released each month. The conservatively calculated maximum offsite dose resulting from the tritium released will be minimal: approximately l 0.005 crem/yr. (Tnis incremental dose is equivalent to spending one day in a l stone building instead of a wooden building.) The polar crane refurbishrent and other recovery activities will be conducted in parallel with the reactor building decontamination during the entries. 4 EPICCR 11 prefilter Shior.ent Status Preparations are continuing for the shipment of several EPICOR 11 prefilter liners during the month of October 1982. Currently, PF-2 and PF-6 have been sampled, inerted with nitrogen gas and stored onsite at the sclid waste storage facility (SWSF) awaiting shipment to Idaho National Engineering Labcratory (INEL). The PF-5 liner gas analysis indicated 99% nitrogen, 0.4t cxygen anc ncn-cetectable (<0.1%) hydrogen at approximately 3.5 psi negative pressure. The slight negative pressure reading was apparently due to the radiolytic cxygen depietion mechanism in the EPICOR 11 prefilters. The HN-200 type B shipping cask is scheduled to arrive at the TMI site on - October i and liner PF-2 is scheduled for shipment to INEL on Ocicber 5, 1952. The FF-5 liner, which contains approximately 170 curies of fission prcducts, will ce placed in tne existing SN-1 type B shipping task (designed to witnstand transportation acticents) to determine if this relatively low curie liner can meet the DOT /NRC dose rate recuirements. This demonstration is expected to be templeted by October 1,1982. Future Yeetirps 1. 4 OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest i Week Ending September 24, 1982 Acolication for Renewal of SNM License By application dated August 20, 1982, Energy Systems Group of Rockwell Inter-national submitted an application for renewal of its Special Nuclear Material License No. SNM-21. Much interest has been expressed by the " San Fernando Valley Alliance for Survival" and by other residents of the Los Angeles area in the NRC review and action on the application. In addition, there have been approximately 200 to 300 requests from local citizens for a hearing prior to issuance of the renewed license. Revision of Stabilization Plan A meeting was held with representatives of Kerr-McGee Chemical Corporation (K-M) on September 17, 1982, at their request. At the meeting, K-M infortned NMSS that they intend to submit a revision to their Stabilization Plan for the West Chicago, Illinois, site. The major change in the forthcoming submittal will be a commitment by K-M to retain ownership of the disposal site for twenty-five years. This revision would replace the Kerr-McGee preferrec option evaluated in the DEIS published May 1982. Low-Level Waste Storage at Reactor Site On September 17, 1982 a Materials License was issued pursuant to 10 CFR Part 30 l to TVA authorizing use of the Low-Level Radioactive Waste Storage Facility at the Sequoyan Nuclear Plant. The concrete storage modules will be used for con-j tingency storage of low-level wastes generated at the site. The term of the i license is five years. Issuance of the license and the related Negative Declara-tion are being r.:ticed in the Federal Register along with announcement of the availability of tne staff's SER and EIA. A similar proposed action for contin-gency waste storage at TVA's Browns Ferry site was contested and is being considered by the ASLAB. Scent Fuel Storage l On September 16, 1982 N"SS/FCAF staff met the Gesellschaft fuer Nuklear Service, mDH (GNS) to discuss written comments previously provided to GNS concerning the completeness and technical acequacy of its submitted Topical Report (TR) on a cry cask type independent spent fuel storage installation (ISFSI). These comments, prepared with technical assistance of Lawrence Livermore National Laboratory staff, fall into three categories: 1) the need to format the TR into a conerent document following Regulatory Guide 3.3B; 2) the need to include accitional information, data and analyses; and 3) the suggestion that ne recort accress an at-reactor site ISFSI only, adequately defining, for purposes of a safety review, a single loaded cask and representative arrays of casts. P 4 Semiscale The task action group established to review B&W design research facilities held its first meeting last week. Discussions centered on the phenomena and tests which RES believes are necessary to resolve questions concerning 2 x 4 loop designs to respond to accident conditions and accident signatures operators can expect to see. Representation included AEOD, ACRS, RES, NRR, utilities. EPRT, and B&R. A large amount of information is contained in the Semiscale 2 X 4 loop study perfomed by EG&G. Additional views - i are being prepared for discussion by the group with the goal of arriving at the most cost-effective means of resolving safety issues and data needs. The final report on the Semiscale feed and bleed tests has been received. The report is being distributed for study and determination as to whether or not additional testing is needed. i 2D/3D As part of the 2D/3D Agreement, the USNRC is to provide the data acquisition system (DAS) to the German Upper plenum Test Facility (UPTF). This DAS will acquire data from 1152 channels of instrument signals at a rate of 50,000 samples /second. The sampling rate of instrument signals varies from 25 Hz to 150 Hz. The design features and the detailed interface with the Federal Republic of Germany will be discussed on October 5,1982 in the lith Floor Conference Room of the Willste Building. PBF The fuel rod asse :bly and flow shroud modules for the secon'd 32-rod PBF severe fuel damage test, SFD-1, were shipped from PNL to EG&G, Idaho on September 15, 1982. SRV Discharge Tests The final report on the in-plant SRV discharge tests at Kuosheng 1 Taiwan has been received and will be distributed shortly. PTS INEL has completed two calculations for the PTS study of the Oconee-plant; main steam-line break and small-break LOCA. NRC Guidelines on Post-Accident Recovery l Clark Prichard and Enrico Conti, DHSWM received a telephone inquiry from the GAO (Cliff Gardner, Denver Office) regarding the status and possible content of NRC guidelines on post-accident recovery. Mr. Gardner was told that the staff expects to recommend to the Commission, by about mid-October, that a broad policy statement be prepared rather than specific technical criteria. Assistance on Northeast Compact A working paper, " State Role in the Regulation of Low-Level Radioa:tive Waste," was sent on September 21, 1982 to the Coalition of Northeastern Governors (CONEG) Low-Level Waste Policy Working Group in preparation for a meeting that will be held in Albany, New York, on September 30 and October 1, 1982. The paper was written by Faith Brenneman, Regional State Liaison Officer, Regir,n I and Steve Salomon, OSP. Conference of Radiation Control Prohram Directors' Meeting Frank Young, OSP and Paul Lohaus and Ken Jackson, WM/NHSS attended this week in Louisville, Kentucky a meeting of selected State Radiation Control Program Directors (CRCPD). The meeting was to launch the effort in support of a DOE grant to gather data on low-level waste generated (not just that disposed). Not only will the developed data be used by States and compacts for planning purposes, but it is also neeced by legislators, Governors, and others who are called on for decisionmaking. A draft questionnaire was developed which, when completed, will be distributed by the State program directors to all licensees -- both Agreement State and NRC. Assistance from NRC will be in the form of a list of NRC licensees. TMI Cleanuo Lecislation 4 Representatives James Florio (NJ) recently introduced a bill (H.R. 7031) in the House to allow voluntary utility contributions to fund TMI-2 cleanup. This bill would remove antitrust considerations in voluntary funding and preclude derivative suits by shareholders. STAFF REQUIREMENTS: TMI-1 RESTART CONTESTED ISSUES, Memo SECY to D1rcks, 9/24/E2 At a September 10 closed meeting on TMI-l restart contested issues, the Commission agreed to treat generically the Special Master's and Licensing Board's discussions of the NRC written operator examinations. The Special Master's report and Board Partial Initial Decision on cheating contain evidence and analyses of NRC examination weaknesses, both in content and a:iministration. The Ccmmission asks that the concerns raised in these documents i about the NRC operator licensing (examination) process be i ~ addressed as part of the staff's existing human factors program to re-evaluate and improve the NRC operator examinations and operator training programs. In particular, the staff should ensure that the problems evidenced at TMI regarding l the accuracy and credibility of the exams are addressed, and that any weaknesses resulting from simultaneous reliance on licensee training and the NRC exams as independent checks of i ( each other are addressed. The proposed fee schedule should reflect the revised professional staff-year rates contained in the EDO's memorandum of November 3 0, 1981. 1 2. The proposed fee schedule should reflect the revised radioisotope licensing and inspection fees contained in j the EDO's memorandum of June 4, 1982. l 1 3. The proposed rule should be modified to include a statement that it will be reviewed annually and adjusted as necessary to take into consideration cost changes due to salary increases and inflation. 4. In ecnnection with the six-month billing cycle, the Cc= mission should be furnished a report. showing the total amount billed, the amount collected, and the arount of contract costs and staf f ef fort recovered. 5. The Cc= mission has agreed to continue to exempt State and local government and non-profit institutions. 6. The Commission has agreed that orders and resultant j amendments and approvals will not be made subject to ~ fees by amending Part 170. 7. C. 484), revenues from licensing fees, inspection services and other services and collections (excluding moneys for cooperative nuclear safety research programs and the material access authorization program) estimated at S60,000.000 in fiscal year 1983 may be retained and used for necessary expenses in this account, and may remain available until expended: Provided further, That the sum herein appropriated shall be reduced as revenues are received during fiscal year 1983 so as to result in a final fiscal year 1983 appropriation estimated 4 at not scre than S414,500,000." i If schedule slips occur, there may be significant shortfalls in available licensing fees. The EDO should develop a contingency plan for this possibility. Commissioner Ahearne disagreed in part with the Ccnr.ission decisien adding the following comments: 1. I would amend item #1 as followc " strike memorandum of November 30, 1981" and add " memoranda of November 30, 1981 and April 26, 1982". 2. I would also add the 650 educational institutions, 53 Part 50 licenses, and the other non-Federal licenses listed in the EDo's April 16 memo under Item 3. As the IDO stated: "The irposition of fees on Federal agencies for licenses inspecticns would recuire legislation since the legislation under which the Commission imposes fees expressly exempts Federal agencies. All of the other exemptions frc= fees could be eliminated from Part 170 by the Cc= mission." 3.
