ANNUAL ASSESSMENT LETTER FOR WOLF CREEK GENERATING STATION (REPORT 05000482/2018006)

Dear Mr. Heflin:

The U.S. Nuclear Regulatory Commission (NRC) has completed its end-of-cycle performance assessment of Wolf Creek Generating Station, reviewing performance indicators (PIs),

inspection results, and enforcement actions from January 1, 2018, through December 31, 2018.

This letter informs you of the NRCs assessment of your facility during this period and its plans for future inspections at your facility. The NRC concluded that overall performance at your facility preserved public health and safety.

The NRC determined the performance at Wolf Creek during the most recent quarter was within the Licensee Response Column, the highest performance category of the NRCs Reactor Oversight Process (ROP) Action Matrix, because all inspection findings had very low safety significance (i.e., Green), and all PIs were within the expected range (i.e., Green). Based on the results of a supplemental inspection completed on September 20, 2018, which reviewed your stations actions in response to a Greater-than-Green finding in the Security Cornerstone, the NRC informed you that the finding was closed and that Wolf Creek was transitioned to the Licensee Response Column, effective November 2, 2018 (Agencywide Document Access Management System (ADAMS) Accession No. ML18306A496). Therefore, the NRC plans to conduct ROP baseline inspections at your facility.

On December 17, 2018, the NRC issued a Severity Level II Notice of Violation and Proposed Imposition of Civil Penalty associated with a violation of 10 CFR 50.7, Employee Protection, for actions Wolf Creek took in response to a contract employee raising nuclear safety concerns (ADAMS ML18333A043). On January 15, 2019, Wolf Creek notified the NRC of its acceptance of the violation (ADAMS ML19024A206). Therefore, the NRC plans to conduct Inspection Procedure 92722, Follow Up Inspection For Any Severity Level I or II Traditional Enforcement Violation or For Two or More Severity Level III Traditional Enforcment Violations in a 12 Month Period, to follow-up on this violation.

The NRC notified you in the 2017 annual assessment letter of a cross-cutting theme (ADAMS ML18052A345) related to the inconsistent implementation of Safety-Conscious Work Environment (SCWE) Policy (S.1). The NRC conducted several inspections during the assessment period to assess the corrective actions taken to address this theme, including a Problem Identification and Resolution Inspection (Inspection Report 05000482/2018007 (ADAMS ML18218A265)) and a quarterly Integrated Inspection (Report 05000482/2018004 (ADAMS ML19042A089)). Based on these inspections and review of your actions taken and planned, as well as the issuance of the aforementioned violation of 10 CFR 50.7, the NRC determined that a theme in the SCWE area continues to exist. This is the second consecutive occurrence of this cross-cutting theme. The NRC plans to conduct Inspection Procedure 93100, Safety-Conscious Work Environment Issue of Concern Followup, concurrent with Inspection Procedure 92722, to assess your progress in addressing the open SCWE theme at Wolf Creek. These inspections will be scheduled after you provide written notification to the NRC of your readiness for the inspection.

The enclosed inspection plan lists the inspections scheduled through December 31, 2020.

This updated inspection plan now includes planned security inspections that were formerly transmitted under separate correspondence. The NRC provides the inspection plan to allow for the resolution of any scheduling conflicts and personnel availability issues. Routine inspections performed by resident inspectors are not included in the inspection plan. You should be aware that the agency is pursuing potential changes to the ROP, including changes to engineering inspections (SECY-18-0113, Recommendations for Modifying the Reactor Oversight Process Engineering Inspections). Should these changes to the ROP be implemented, the engineering and other region-based inspections are subject to change in scope, as well as schedule, beginning in January 2020. The inspections listed during the last 12 months of the inspection plan are tentative and may be revised. The NRC will contact you as soon as possible to discuss changes to the inspection plan should circumstances warrant any changes.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
