Dan, The NRC staff completed the LIC-109 acceptance review of the Relief Request (RR) #11-001-MX, Revision 0, submitted by Florida Power Corporation dated December 27, 2011 (ML12004A074, TAC No. ME7729). The relief requested is for the fourth 10-year ISI interval (second 10-year containment ISI interval) for Crystal River Unit 3 (CR-3). The licensee has submitted the request pursuant to 10 CFR 50.55a(g)(5)(iii) [and (g)(6)(i)] on the basis of impracticality. The submittal requests suspension of the schedule requirements of IWL-2410 and IWL-2420 of ASME Code,Section XI, Subsection IWL, for performing concrete and unbonded post-tensioning system examinations as they apply to CR-3's 35th year (9th Surveillance) CISI examination, and to forgo performance of any outstanding examinations during the CR-3 containment repair period. The licensee states that completing the examinations required for this current 5 year interval is deemed impractical due to the ongoing extensive repair of the delaminated CR-3 containment structure.

Based on the criteria in Appendix B, Guide for Performing Acceptance Reviews, as addressed in Section 3.1.2, Technical Staff Criteria, and Section 3.2.3, Acceptable for Review of the LIC-109 Acceptance Review Procedure, Revision 1, the NRC staff finds that the relief request includes sufficient information for staff to proceed in conducting a detailed technical review. The NRC staff notes that based on the initial read of the application, there may be potential areas where additional information may be needed, which can be addressed by the request for additional information process during the detailed review. Therefore, the NRC staff finds this RR submittal: Acceptable for Review.
