Dear Mr. Saporito:
This is a periodic status update regarding your 10 CFR 2.206 petition dated December 5, 2009, as supplemented by portions of your petition dated August 6, 2010, against Progress Energy, representing Florida Power Corporation (the licensee) at Crystal River Nuclear Generating Plant, Unit 3 (CR-3). This status update fulfills the guidance in Management Directive 8.11, Review Process for 10 CFR 2.206 petitions for period status updates.
Currently, Duke Energy, of which Progress Energy is a wholly owned subsidiary, is evaluating the future of the Crystal River site. As you have been previously been informed, the current date for issuance of the proposed directors decision, which is predicated on the licensees decision regarding the repair or retirement of CR-3, is December 3, 2013. The current date reflects need to obtain the information that is linked to the licensees decision on the future of the plant and the extent of the Crystal River containment repair/replacement. No new changes to the status of your petition have occurred since our last status update on November 14, 2012.
As part of the NRC staffs regular rotation, I have assumed the duties of the Licensing Project Manager for Crystal River, including the responsibility of managing your petition related to the CR-3 site submitted in accordance with 10 CFR 2.206. Ms. Farideh Saba will no longer be your contact for this petition.
