A teleconference was held between representatives from FPL Energy Point Beach and the NRC Staff on February 6, 2009. The purpose of the teleconference was to discuss supplemental information needed by the staff to support the review of License Amendment Request 241, "Alternative Source Term." provides the NRC staffs questions, the FPL Energy Point Beach, LLC responses, and contains two new regulatory commitments.

This supplement does not affect the no significant hazards conclusion, as defined in 10 CFR 50.92, provided in Reference (1).

Document Control Desk Page 2 Summarv of Reaulatory Commitments The following two new Regulatory Commitments for the primary auxiliary building ventilation (VNPAB) system are proposed:

The VNPAB system will be added to the scope of the Maintenance Rule (10 CFR 50.65) and the scope of the License Renewal Program (10 CFR 54.37(b)). These actions will be completed during the Unit 1 (Spring 2010) refueling outage that implements the LAR.

FPLE Energy Point Beach, LLC will submit proposed TS for the VNPAB system by April 21, 2009.

In accordance with 10 CFR 50.91, a copy of this letter is being provided to the designated Wisconsin Official.

ENCLOSURE I FPL ENERGY POINT BEACH, LLC POINT BEACH NUCLEAR PLANT, UNITS I AND 2 SUPPLEMENT TO LICENSE AMENDMENT REQUEST 241 ALTERNATIVE SOURCE TERM The following information is provided as a follow-up from the teleconference between the NRC staff and representatives from FPL Energy Point Beach, LLC, dated February 6, 2009. The information supports review of License Amendment Request 241, "Alternative Source Term" by the staff.

Questions 1and 2:

1. The licensee is crediting the Control Room Ventilation System (VNCR) and the Primary Auxiliary Building Ventilation (VNPAB) System for implementing the AST. However, the licensee submittal did not make any mention of adding these systems to the scope of the Maintenance Rule program in accordance with 10 CFR 50.65, and to the scope of the license renewal in accordance with 10 CFR 54.37(b).
2. The above equipment should also be added to the Technical Specifications (TS) with appropriate Limiting Condition for Operation (LCO) and Sun/eillanceRequirements (SR) because the equipment is required for safe operation of the facility as required by 10 CFR 50.36(d)(2)(io(C), Criteria 3, "A structure, system, or component that is part of the primary success path and which functions or actuates to mitigate a design-basis accident or transient that either assumes the failure of or presents a challenge to the integrity of a fission product barrier. "

FPL Enersrv Point Beach Response:

The Control Room Emergency Filtration System (CREFS) is the portion of the Control Room Ventilation System that supports the radiological habitability of the Control Room. CREFS is currently in the Point Beach Nuclear Plant Technical Specifications (TS). CREFS is also within the scope of the Maintenance Rule Program (10 CFR 50.65) and the License Renewal Program (10 CFR 54.37(b)). The new alignment currently proposed in LAR 241 does not require Technical Specification changes other than those previously submitted.

Two new regulatory commitments for the VNPAB system are proposed:
