Dear Administrative Judges:

The staff of the U.S. Nuclear Regulatory Commission (the Staff) has identified the documents described in the attachments hereto in accordance with the schedule set out in the Atomic Safety and Licensing Boards April 20, 2010 Memorandum and Order (Summarizing Prehearing Conference Call and Amending Hearing Schedule) and the provisions in the May 13, 2010 Order (Defining Scope of Discovery) regarding mandatory disclosure in connection with the safety culture contention in this proceeding. All of the documents are accessible through the Agency Wide Document Access Management System (ADAMS) and/or the Nuclear Regulatory Commissions (NRC) website. Attachment 1 consists of an index stating the date and title of each document and either its ADAMS accession number or the location of the document on the NRC website. Since all of the documents are accessible via ADAMS or the NRC website, none of them are being produced in paper form.

Pursuant to 10 C.F.R. § 2.336(b)(5), the Staff has produced a privilege log identifying documents withheld under the deliberative process privilege (Attachment 2). The Declaration of Gary Shear, which formally invokes the deliberative process privilege with respect to the documents identified in the privilege log, is Attachment 3. During the pendency of this proceeding, the Staff will maintain and preserve all of the documents identified in the privilege log.

Finally, the Staff respectfully maintains that safety culture documents are not encompassed by the provisions of 10 C.F.R. §§ 2.336(b) or 1203(b) and thus are not subject to mandatory disclosure or production through the hearing file. Nevertheless, in order to comply with the Licensing Boards rulings in this proceeding, the Staff has identified documents that relate to the safety culture contention and its bases. By identifying the documents in Attachments 1 and 2, the Staff does not concede their relevance to license renewal.

DECLARATION OF GARY L. SHEAR I, Gary L. Shear, do hereby state as follows:

1. I am employed as the Deputy Director of the Division of Reactor Projects in the U.S. Nuclear Regulatory Commission's ("NRC) Region Ill Office. My supervisory responsibilities include oversight of the Staff's inspection activities at the Prairie Island Nuclear Generating Plant Units 1 and 2.
2. As part of their responsibilities in preparing mandatory disclosures relevant to these proceedings, NRC staff members under my supervision identified certain documents as privileged because they contained information concerning the Staff's pre-decisional deliberative process. Those documents are listed in Attachment 2 to the NRC Staff's June 18, 2010, Mandatory Disclosure.
3. I have personally reviewed the documents identified as privileged in Attachment 2, and have determined, in accordance with the guidance set forth in Management Directive 3.4, that they contain pre-decisional information concerning the Staff's inspection activities. All documents contain the Staff's analyses, recommendations, opinions, or evaluations, and may not necessarily reflect the final agency position with respect to the matters discussed therein.

Each of the documents comprises part of the deliberative process necessary for the Staff's inspections and reports documenting and evaluating the results of those inspections.

4. Further, I have determined that disclosure of these documents could result in harm to the agency, in that it would (a) disclose the preliminary views of individual Staff members and/or the Staff prior to reaching a final agency decision, and could thus create confusion as to the actual policy or views of the NRC Staff; or (b) hinder the efficiency of the Staff, in that forced disclosure of its internal discussions would tend to chill all future deliberations and would interfere with the Staff's ability to engage in a free exchange of opinions and analyses prior to publishing its final positions..
5. Accordingly, I formally invoke the deliberative process privilege with respect to each of the documents listed in Attachment 2 to the Staff's June 18, 2010, Mandatory Disclosure.
6. 1 declare under penalty of perjury that the foregoing is true and correct to the best of my knowledge, information and belief.
