MIDCYCLE PERFORMANCE REVIEW AND INSPECTION PLAN -

CALLAWAY PLANT

Dear Mr. Randolph:

On August 6, 2003, the NRC staff completed its midcycle plant performance assessment of Callaway Plant. The midcycle review for Callaway Plant involved the participation of all technical divisions in evaluating performance indicators (PIs) for the most recent quarter and inspection results for the first half of the current assessment cycle, January 1 through December 31, 2003. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility so that you will have an opportunity to prepare for these inspections and to inform us of any planned inspections that may conflict with your plant activities.

Plant performance for the most recent quarter was within the Regulatory Response column of the NRCs Action Matrix based on one finding of low to moderate safety significance (White) in the Emergency Preparedness Cornerstone for failure to comply with the requirements of 10 CFR 50.47(b)(5). Consequently, in addition to baseline inspections, Inspection Procedure 95001, Inspection for One or Two White Inputs in a Strategic Performance Area, will be performed later during this assessment cycle to review your evaluation of root causes, extent of condition, extent of cause, and corrective actions associated with this issue.

In our midcycle assessment letter dated August 27, 2002, we advised you of a substantive crosscutting issue in the area of problem identification and resolution. This issue was updated in our annual assessment letter dated March 4, 2003. NRC recognizes that you have implemented a number of actions intended to improve the processes associated with your corrective action program and that your performance in this area has demonstrated improvement. However, during the past 12 months, two findings were identified in the Mitigating Systems cornerstone where problem identification and/or resolution were inadequate.

The findings, both of very low safety significance (Green), included the failure to correct a recurring air voiding condition in the containment spray system and not promptly identifying, correcting, or precluding recurrence of an industry known potential significant condition adverse to quality associated with failures of Magne-Blast 4160 volt circuit breakers. Given the recurring identification of findings associated with problem identification and resolution, we will continue to monitor your performance with regard to this substantive crosscutting issue during implementation of the baseline inspection program and Inspection Procedure 95001.

Union Electric Company The enclosed inspection plan details the inspections scheduled through September 30, 2004.

The inspection plan is provided to minimize the resource impact on your staff and to allow for scheduling conflicts and personnel availability to be resolved in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature.

The inspections in the last 6 months of the inspection plan are tentative and may be revised at the end-of-cycle review meeting.

In accordance with 10 CFR 2.790 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
