This refers to our letter dated June 29, 1987, which forwarded the results of a special safety inspection conducted to review the circumstances surrounding the inoperability of both trains of the spray additive portion of the Unit I containment spray system (NRC Inspection Report 454/87022(DRP)).

That letter stated that you would be notified of our decision regarding enforcement actions.

Our evaluation of the matter is complete, and the NRC staff has determined that certain of your activities appear to be in violation of NRC requirements as described in the enclosed Notice. The inspection results show that the unit was operated contrary to the requirements of:

1) Technical Specification 3.0.4 when Mode 4 was entered on two occasions with both trains of the spray additive system inoperable; and 2) Technical Specification 3.6.2.2 when the unit was not placed in Mode 5 within the next 30 hours3.472222e-4 days <br />0.00833 hours <br />4.960317e-5 weeks <br />1.1415e-5 months <br /> with both trains of the spray additive system inoperable for greater than 120 hours0.00139 days <br />0.0333 hours <br />1.984127e-4 weeks <br />4.566e-5 months <br />.

We discussed this issue at an Enforcement Conference held in the Region III office on July 9,1987, between M". T. J. Maiman and members of your staff and me and members of my staff.

Becam, of the safety significance of these violations, we have concluded that the appropriate enforcement action for this event is the issuance of a Severity Level IV violation. A written response is required.

In a letter to you dated April 20, 1987, we described our concern that you were experiencing an excessive number of violations at the Byron Nuclear Station resulting in redundant trains of safety related equipment being,aade inadvertently inoperable. This event represents a fourth example of redundant equipment inoperability within seven months. We are seriously concerned about your staff's performance in ensuring the operability of safety related systems.

In your response to this violation, please describe the corrective actions you plan to take or have taken to improve station performance and personnel awareness of the need to safeguard the operability of safety related equipment.

We will view any future significant violations as indicative of a failure of your management system to effectively implement those corrective actions and as basis for escalated enforcement action.
