This refers to the management inspection conducted by Messrs. E. B. Blackwood, L. E. Foster, J. E. Gagliardo and W. D. Shafer of.We NRC/0IE Performance Appraisal Branch on May 14 through May 25, 1979, of activities authorized by NRC Operating License Nos. DPR-62 and DPR-71 for the Brunswick Steam Electric Plant Units I and 2, Southport, North Carolina and Company offices in Raleigh, North Carolina, and to the discussion of the findings held with Mr. H. R. Banks and others on May 25, 1979 at your general offices.

The enclosed copy of the inspection report (Enclosure 3) identifies the areas examined during the inspection. Within these areas, the inspection consisted of a comprehensive examination of your management controls over licensed activities which included an examination of procedures and records plus extensive interviews with many of your management and supervisory personnel.

This inspection was one of a series of management appraisal inspections conducted

by the NPC Performance Appraisal Branch. The results of this inspection will be used to evaluate the performance of your management control systems from a national perspective. The enclosed inspection report addresses the enforcement findings from this inspection and the observations which will provide the basis for the subsequent performance appraisal. Paragraph 2 of the enclosed report provides additional information regarding the findings and how they will be utilized.

Eight new unresolved items resulted from this inspection and are discussed in the enclosed report. These items will be examined during subsequent inspections.

During this inspection it was found that certain activities under your license appear to be in noncompliance with NRC requirements. These items and references to pertinent requirements are listed in the Notice of Violation enclosed herewith as Appendix A.

This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal }legulations.

Section 2.201 requires you to submit to this office, within 20 days of your receipt of this notice, a written statement or explanation in reply including:

(1) corrective steps which have been taken by you and the results achieved; (2)

corrective steps which will be taken to aviod further noncompliance; and (3) the date when full compliaqpe will be achieyeq.

During this inspection, it was also found that one of your activities appeared to deviate from your communent to the Commission, as set forth in the Notice of Deviation enclosed herewith as Appendix B.

Please submit to this office, within twenty (20) days of your receipt of this notice, a written statement or explana-tion in reply including the cause of the deviation and the steps you plan to take to assure timely implemen ' tion and completion of corrective actions. Your written reply should include th_ date(s) when your corrective action (s) were or will be completed.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosed inspection report will be placed it the NRC's Public Document Room.

If this report contains any information that you or your :ontractors believe to be proprietary, it is necessary that you make a written application within twenty (20) days to this office to withhold such information from public disclosure.

Any such application must inclub a full statement of the reasons on the basis of which it is claimed that the information is proprietary, and should be prepared so that proprietary information identified in the application is contained in a

separate part of the document. If we do not hear from you in this regard within the specified period, the report will be placed in the Public Document Room.

APPENDIX A NOTICE OF VIOLATION Carolina Power and Light Company License Nos. DPR-62 Brunswick Steam Electric Plant, Units 1 & 2 DPR-71 Based on the results of the NRC inspection conducted on May 10.-25, 1979, it appears that certain of your activities were not conducted in full compliance with NRC requirements as indicated below. These items have been categorized as described in our correspondence to you-dated December 31, 1974.

A.

Technical Specifications Section 6.9.1.9.b requires the licensee to submit to the Regional Office within 30 days of occurrence, conditions leading to operation in a degraded mode permitted by a limiting condition for operation.

Contrary to the above:

The licensee's records (Limiting Condition for Operation Reports 1-79-5, 6 and 7) indicate that three containment isolation valves were determined inoperable, placing the Unit 1 facility in a degraded mode permitted by a limiting condition for operation.

The licensee's records did not indicate that a 30-day report was submitted to the Regional Office.

On February 19, 1979, during a surveillance test of the High Pressure Coolant Injection System (HPCI), the licensee determined the system had failed the test and as a result placed Unit 2 in a degraded mode permitted by a limiting condition for operation.

This was not reported to the Regional Office.

This is an infraction.

B.

Technical Specifications Section 6.5.1.6.e requires the Plant Nuclear Safety Committee (PNSC) be responsible for investigations of all violations of the Technical Specifications.

Additionally, Technical Specifications Section 6.5.1.7.b requires the PNSC to render determinations in writing with regard to whether or not each item considered under Technical Specifi-cations Section 6.5.1.6.e constitutes an unreviewed safety question.

Contrary to the above, the inspector found, by discussions with licensee representatives and by review of PNSC minute::, that violations of the TS which are identified in NRC inspection reports were not investigated by PNSC as required above.

This is an infraction.
