Thank you for your letter dated March 3, 1982, informing us of your position in response to the items of noncompliance which we brought to your attention in Inspection Report No. 50-295/81-28; 50-304/81-26 forwarded by our letter dated January 28, 1982.
After reviewing your letter and supporting material, we do not agree with your conclusion that these items did not constitute violations. We recognize that IE Bulletin 79-14 does not specifically require the evaluations discussed in the inspection report; however, we are sure you realize that failure to meet FSAR commitments is the supporting basis of our findings.
IE Bulletin 79-14 provided temporary relief from these commitments provided your seismic evalua-tions demonstrated piping system stresses were within certain predetermined operability criteria concurred in by the NRC. We will examine these matters during a subsequent inspection.
