NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 50-261/94-13)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by Mr. William T. Orders during the period April 22 through April 29, 199 The inspection included a review of the facts and circumstances of an event which occurred on April 22, 1994, in which there were no licensed operators present at the controls of the facility which was operating at 100% power. This event was identified and reported by your staff. The report documenting this inspection was sent to you by letter dated May 6, 1994. As a result of this inspection, a failure to comply with NRC regulatory requirements was identified. An enforcement conference was held on May 16, 1994, in the NRC Region II office, Atlanta, Georgia, with you and members of your staff to include the licensed operator involved in the event to discuss the violation, its cause, and your corrective action to preclude recurrence. The Enforcement Conference Summary was sent to you on May 20, 199 The violation described in the enclosed Notice of Violation (Notice) involved your failure to maintain a licensed operator or senior licensed operator present at the controls during the operation of the facility. The safe operation of a nuclear facility requires the constant attention of licensed operators to reactor operating conditions and parameters so as to ensure prompt action to certain events. This event is a serious concern to the NR It is the latest of a number of recent operations related events, which when viewed collectively, demonstrates a declining trend in the performance of your organization particularly in the area of operations. This area of concern also includes the performance of your licensed operators, and senior operators and their need to pay closer attention to detai In addition, management attention is also needed to communicate clear expectations in this are Notwithstanding the above, the violation has been categorized at Severity Level IV. extremely short duration (i.e., the operator was outside the "the controls area" for five to eight seconds), 3) the event was used as a basis to develop long term corrective actions, and 4) the steady state parameters of the reactor at the time the event occurred reduced the actual safety significanc.You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirement In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter and its enclosure, and your response will be placed in the NRC Public Document Room.
