SUBJECT: INDIAN POINT NUCLEAR GENERATING - MATERIAL CONTROL AND ACCOUNTING INSPECTION REPORT 05000247/2016404 AND 05000286/2016404

Dear Mr. Vitale:

On December 19, 2016, the U.S. Nuclear Regulatory Commission (NRC) completed a security inspection at your Indian Point Nuclear Generating (Indian Point) Units 2 and 3 and discussed the results of this inspection with you and other members of your staff. The results of this inspection are documented in the enclosed report.

The report documents one NRC-identified finding of very low safety significance (Green), which also involved a violation of NRC requirements. However, because of the very low security significance, and because it is entered into your corrective action program, the NRC is treating this finding as a non-cited violation, consistent with Section 2.3.2.a of the NRC Enforcement Policy. If you contest the non-cited violation, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator, Region I; the Director, Office of Enforcement; and the NRC Senior Resident Inspector at Indian Point. In addition, one cross-cutting aspect was assigned to the finding in the area of Human Performance, because the finding involved insufficient staff training and knowledge for a specific material control and accounting activity [H.9]. If you disagree with the cross-cutting aspect assigned to the finding, you should provide a response within 30 days of the date of this report, with the basis for your disagreement, to the Regional Administrator, Region I, and the NRC Senior Resident Inspector at Indian Point.

This letter will be made available for public inspection and copying at http://www.nrc.gov/reading-rm/adams.html and at the NRC Public Document Room in accordance with 10 CFR 2.390, "Public Inspections, Exemptions, Requests for Withholding." Enclosure contains Sensitive Unclassified Non-Safeguards Information. When separated from enclosure, the transmittal document is decontrolled. However, the enclosed report contains Security-Related Information, so the enclosed report will not be made publically available in accordance with 10 CFR 2.390(d)(1). If you choose to provide a response that contains Security-Related Information, please mark your entire response "Security-Related Information-Withhold from public disclosure under 10 CFR 2.390" in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). The NRC is waiving the affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
