ANNUAL ASSESSMENT LETTER FOR INDIAN POINT NUCLEAR GENERATING, UNITS 2 AND 3 (REPORT 05000247/2016006 AND 05000286/2016006)

Dear Mr. Vitale:

The U.S. Nuclear Regulatory Commission (NRC) has completed its end-of-cycle performance assessment of Indian Point Nuclear Generating (Indian Point), Units 2 and 3, reviewing performance indicators (PIs), inspection results, and enforcement actions from January 1, 2016, through December 31, 2016. This letter informs you of the NRCs assessment of your facility during this period and its plans for future inspections at your facility. The NRC concluded that overall performance at your facility preserved public health and safety.

The NRC determined the performance at Indian Point Unit 2 during the most recent quarter was within the Licensee Response Column, the highest performance column of the NRCs Reactor Oversight Process (ROP) Action Matrix in Inspection Manual Chapter (IMC) 0305, Operating Reactor Assessment Program, because all inspection findings had very low safety significance (i.e., Green), and all PIs were within the expected range (i.e., Green). Therefore, the NRC plans to conduct ROP baseline inspections at Unit 2.

The NRC determined the performance at Indian Point Unit 3 during the most recent quarter was within the Regulatory Response Column, the second highest performance column of the NRCs ROP Action Matrix in IMC 0305. This conclusion was based on a White PI for Unplanned Scrams per 7,000 Hours Critical, which crossed the Green-White threshold on December 14, 2015, due to an unplanned automatic scram. In response to this White PI Action Matrix input, the NRC performed a supplemental inspection using Inspection Procedure (IP) 95001, Supplemental Inspection Response to Action Matrix Column 2 Inputs. The IP 95001 inspection was successfully completed on October 13, 2016, and by letter dated November 21, 2016 (ML16326A0641), Indian Point Unit 3 transitioned to the Licensee Response Column.

The designation in parentheses refers to an Agencywide Documents Access and Management System (ADAMS) Accession Number. Documents referenced in this letter are publicly available using the Accession Number in ADAMS. The enclosed inspection plan lists the inspections scheduled through December 31, 2018. The NRC provides the inspection plan to allow for the resolution of any scheduling conflicts and personnel availability issues. Routine inspections performed by resident inspectors are not included in the inspection plan. The inspections listed during the last twelve months of the inspection plan are tentative and may be revised. The NRC will contact you as soon as possible to discuss changes to the inspection plan should circumstances warrant any changes.

This inspection plan does not include the plan for security-related inspections, which will be sent via separate, non-publicly available correspondence.

In addition to the baseline inspections, the NRC will conduct IP 60845, Operation of Inter-Unit Fuel Transfer Canister and Cask System, and IP 60855.1, Operation of an ISFSI at Operating Plants. Additionally, NRC staff will perform Temporary Instruction 2515-192, Inspection of the Licensees Interim Compensatory Measures Associated with the Open Phase Condition (OPC)

Design Vulnerabilities in Electric Power Systems.

On December 3, 2014, the NRC issued one Severity Level III traditional enforcement violation at River Bend Station associated with a willful violation of Title 10 of the Code of Federal Regulations (10 CFR) Part 73. As part of an Alternate Dispute Resolution mediation settlement agreement between Entergy and the NRC, an Order was issued (ML14339A167) requiring verification at all Entergy sites. In accordance with IMC 0305, Section 13.02.b, the NRC will follow up at Indian Point on the violation through IP 92702, Follow-up on Traditional Enforcement Actions Including Violations, Deviations, Confirmatory Action Letters, Confirmatory Orders, and Alternative Dispute Resolution Confirmatory Orders. This inspection will be conducted during the routine security baseline inspection on July 17, 2017.
