ENCLOSURE 1 NOTICE OF VIOLATION TU Electric Docket Nos.: 50-445 50-446 Comanche Peak Steam Electric Station License Nos.: NPF-87 NPF-89 During an NRC inspection conducted on April 28 through May 2,1997, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

10 CFR Part 50, Appendix B, Criterion V states, in part, ". . . activities affecting quality shall be prescribed by documented instructions, procedures, or drawings, of a type appropriate to the circumstances . . . Instructions, procedures, or drawings shallinclude appropriate quantitative or qualitative acceptance criteria for determining that important activities i. ave been satisf actorily accomplished."

Contrary to the above, on April 28,1997, the NRC identified that no instructions or procedures existed at the Comanche Peak Steam Electric Station to ensure that all licensed operators, who have their licenses conditioned to wear corrective lenses for the eye, always have available appropriate lenses qualified for use with a self-contained breathing apparatus. They would be required to wear such lenses while performing some licensed duties.

This is e Severity Level IV violation (Supplement l}(50-445;-446/9706-01).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket  ;

in the enclosed NRC Inspection Report 50-445;-446/97-06. However, you are required to '

submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation,"

and send it to the U. S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D. C. 20555 with a copy to the Regional Administrator, Region IV, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction. However, if you find it i necessary to include such information, you should clearly indicate the specific information

! that you desire not to be placed in the PDR, and provide the legal basis to support your request for withholding the information from the public.
