Pursuant to 10CFR50.90, Long Island Lighting Company (LILCO or the Company) hereby submits a request to' amend Facility Operating s .

License NPF-82 to create a-Defueled Facility Operating License.

The. regulatory and technical bases for LILCO's request are provided in the attached documents, described below.

I. Introduction

l. Under the Settlement Agreement between itself and New York State, <

l LILCO is contractually bound never to operate Shoreham. Under the Settlement Agreement, LILCO will cooperate with the Long Island Power Authority (LIPA) in seeking NRC approval to transfer Shoreham to LIPA. In anticipation of this eventual transfer, LILCO has removed the fuel from the plant's reactor and placed it in the spent fuel pool.

The costs incurred by LILCO for maintenance of Shoreham will be reflected in the rates paid by the Company's customers. The NRC's approval of the enclosed requests will enable the Company to reduce these costs, without lessening the protection afforded the public health and safety. LILCO also anticipates that approval of its request for a Defueled Facility Operating License will, by reducing licensee authorities and responsibilities, facilitate the eventual transfer of Shoreham to LIPA.

The changes that: LILCO proposes to make through' the enclosed

~ license amendment request serve tx) recognize that Shoreham will not be operated. The proposed changes will have no adverse environmental impacts.

This submittal' consists of three separate documents, each i designated as an attachment to this letter. A description of how these three documents fit together is provided below.

II. Attachment 1 - License Amendment Request Attachment 1.is an application to amend NPF-82. Through this amendment request, LILCO seeks to revise its license to provide that LILCO is authorized to " possess, use, but not operate" Shoreham. Attachment 1 also includes a summary of the major changes.that_LILCO proposes to make to NPF-82 and the plant's technical specifications.

. As required by 10CFR 50.91(a) (1) , the amendment request also include a "no significant hazards consideration" analysis. This analysis concludes that the proposed amendment to remove LILCO's operating authority does not involve a "significant hazards .

consideration," and that LILCO should be granted the proposed amendment to be effective upon issuance.

III. Attachment 2 - Revised License and Technical Specifications To facilitate review of LILCO's license amendment request, Attachment 2 contains a draft of NPF-82 and Shoreham's technical specifications, revised to reflect the changes that LILCO

, proposes to make to those documents. In general, LILCO proposes

! ta) amend the license to (1) remove all language authorizing LILCO to operate the plant, and (2) remove those license conditions l- that are applicable only to power operation; and (3) add a license condition that would require NRC approval prior to L placing any fuel into the reactor pressure vessel. LILCO l proposes to amend the technical specifications to establish a set

! of Limiting Conditions for Fuel Handling and to eliminate all other existing Limiting Conditions for Operation and the Safety Limits section, which are relevant only to Shoreham operation.

IV. Attachment 3 - Defueled Safety Analysis Report The technical justification for LILCO's submittal is contained in Attachment 3, the Defueled Safety Analysis Report (DSAR) . The DSAR, which is intended to serve as an appendix to the Shoreham Updated Safety Analysis Report (US AR) , also provides a precise description of the non-operating, defueled configuration in which Shoreham will be placed if LILCO's amendment request is approved.
