ACCEPTANCE REIVEW RESULTS FOR FENOC FLEET REQUEST TO EXTINGUISH PARENTAL GUARANTY Mr. T. Lentz:

By letter dated March 8, 2010, FirstEnergy Nuclear Operating Company (FENOC), submitted a request for Nuclear Regulatory Commission (NRC) consent to extinguish a parental guaranty for the Beaver Valley Power Station (BVPS), Units 1 and 2, and Perry Nuclear Power Plant (PNPP), Unit No. 1. FENOC, on behalf of FirstEnergy Corp. (FE) and FirstEnergy Nuclear Generation Corp (FENGenCo), requested that the U. S. Nuclear Regulatory Commission (NRC) consent to extinguish the Parental Guaranty between FE and FENGenCo. FENGenCo has concluded that the $80 million Parental Guaranty is no longer needed. FENGenCo has obtained a $15 million Parental Guaranty that will take effect when the existing $80 million Parental Guaranty is extinguished.

The purpose of this letter is to provide the results of the NRC staff

=s acceptance review of this request for consent to extinguish the parental guaranty. The acceptance review was performed to determine if there is sufficient information in scope and depth to allow the NRC staff to complete its detailed review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.75 of Title 10 of the Code of Federal Regulations (10 CFR), the licensee must demonstrate that the proposed changes provide decommissioning funding assurance.

The NRC staff has reviewed your request and concluded that it does provide information in sufficient detail to enable the staff to proceed with its detailed review and make an independent assessment of its acceptability. If additional information is needed for the staff to complete its review, you will be advised by separate correspondence.
