Acceptance Review of Proposed BVPS Emergency Preparedness P Plan Using Nuclear Energy Institute 99-01, Revision 5 By letter dated December 21, 2011 (ADAMS Accession No. ML11362A317), FirstEnergy Nuclear Operating Company submittted a request for NRC approval of an emergencyy action level scheme change to a scheme based b on Nuclear Energy Institute 99-01, Revision n 5, for Beaver Valley Power Station, Units 1 and 2.

The purpose of this email is to provid de the results of the U.S. Nuclear Regulatory Commission (NRC) staff's acceptance review of thist request. The acceptance review was perform med to determine if there is sufficient techniical information in scope and depth to allow the N NRC staff to complete its detailed technical review w. The acceptance review is also intended to ide entify whether the application has any read dily apparent information insufficiencies in its characterization of the regulatory req quirements or the licensing basis of the plant.

The NRC staff has reviewed your re equest, and concluded that it does provide techniccal information in sufficient detail to ena able the staff to proceed with its detailed technicaal review and make an independent assessment regarding the acceptability of the proposed su ubmittal in terms of regulatory requirements and the protection of public health and safety and the environment. If additional informatio on is needed for the staff to complete its technica al review, you will be advised by separate corrrespondence.

In your submittal, you requested an expedited review of the proposed change by Julyy 2, 2012.

Based on NRC staff resource availa ability, this requested disposition date will not be ffeasible.

The NRC staff anticipates that it will disposition the request by December 2012.
