Dear Mr. Lashley,

By letter L-11-293 dated November 14, 2011 (Agencywide Documents Access and Management System (ADAMS) Acc cession No. ML113180450), FirstEnergy Nuclear Operating Company (FENOC, the licensee) su ubmitted a Title 10 to the Code of Federal Regula ations (CFR) 50.55a Request, IR-049, Revision 1, for continued use of the existing Perry Nuclear Power Plant, Unit 1 risk-informed inservice inspection program, with updates, relative to cerrtain non-destructive examination requirements associated with American Society of Mechaniccal Engineers Class 1 piping welds.

The purpose of this e-mail is to prov vide the results of the U.S. Nuclear Regulatory Co ommission (NRC) staffs acceptance review of th his application. The acceptance review was perfformed to determine if there is sufficient techniical information in scope and depth to allow the N NRC staff to complete its detailed technical review w. The acceptance review is also intended to ide entify whether the application has any read dily apparent information insufficiencies in its characterization of the regulatory req quirements or the licensing basis of the plant.

Pursuant to Sections 50.55a(a)(3)(i)) and 50.55a(a)(3)(iii) of 10 CFR, the applicant sh hall demonstrate that the proposed alterrnative would provide an acceptable level of qualiity and safety, or that compliance with the specified s requirements of Section 50.55a would re esult in hardship or unusual difficulty without a compensating increase in the level of quality o or safety.

The NRC staff has reviewed your ap pplication and concluded that it does provide tech hnical information in sufficient detail to enaable the NRC staff to proceed with its detailed tecchnical review and make an independent as ssessment regarding the acceptability of the prop posed application in terms of regulatory req quirements and the protection of public health and safety and the environment. If additional in nformation is needed for the NRC staff to comple ete its technical review, you will be advised d by separate correspondence.
