BEAVER VALLEY POWER STATION, UNIT NOS. 1 AND 2 - WITHDRAWAL OF REQUESTED LICENSING ACTION RE: AMENDMENT REQUEST FOR FIRE PROTECTION PROGRAM CHANGES (EPID L-2022-LLA-0135)

Dear Mr. Grabnar:

By letter L-22-137 dated September 6, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22249A366), Energy Harbor Nuclear Corp. submitted a license amendment request (LAR) for Beaver Valley Power Station, Units 1 and 2. The proposed amendment would modify the bases for two licensing actions that were credited during the transition to the risk-informed, performance-based fire protection program (FPP) in license amendments 301 and 190 (ML17291A081). The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an application for an amendment to a license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

By letter dated October 21, 2022 (ML22294A115), you requested to withdraw the application from NRC review. The NRC acknowledges your request to withdraw the application. NRC staff activities on the review have ceased and the associated Cost Activity Code number has been closed.

The NRC staff notes that its review to date has identified that your application did not provide technical information in sufficient detail to enable the staff to complete its detailed review.

J. Grabnar Therefore, should you decide to re-submit the request, it must include the information requested by NRC letter dated October 6, 2022 (ML22278A097), summarized below:

1. Evaluations of both licensing actions that discusses the continued validity of each considering the proposed changes.
2. Revised license condition that accounts for the LAR and associated safety evaluation (if approved).
3. An evaluation of Attachment K, Existing Licensing Action Transition, of Energy Harbors LAR to transition to NFPA-805, and/or other documents related to the FPP, to identify if any changes are needed to the documents.
