Wolf Creek Nuclear Operating Corporation (WCNOC) is notifying the Nuclear Regulatory Commission (NRC) of a missed quarterly inspection per 40 CFR 266.230(b)(4), which was reported to the Kansas Department of Health and Environment (KDHE) on February 26, 2024.

KDHE approved WCNOCs Low Level Mixed Waste (LLMW) conditional exemption in accordance with 40 CFR 266 Subpart N on April 17, 2014. The exemption is conditional and based upon continued compliance with the requirements of 40 CFR 226.230. WCNOC currently manages 45 pounds of mixed waste (D008, Penetration sealant - silicone impregnated with lead) under the LLMW exemption.

The Reference provided notification to KDHE that WCNOC missed a quarterly inspection, per 40 CFR 266.230(b)(4), of the mixed waste storage area between the dates of January 8, 2022, and August 12, 2022. This is a period of 216 days. All records prior to January 8, 2022, and after August 12, 2022, were accurate and available for review.

All conditions of 40 CFR 266.230 have continuously been met from the period starting on August 12, 2022. The missing inspection record was identified during a routine Quality Assurance Surveillance conducted from January 15, 2024, to January 29, 2024. The condition has been entered in the station corrective action program and immediate actions to report the missed inspection to KDHE per 40 CFR 266.240(a)(1) were completed within 30 days of learning of the failure. Additional actions have included procedure revisions and verification of our internal tracking system to ensure inspections are completed on a quarterly basis. The failure to meet the requirement of 40 CFR 266.230(b)(4) did not endanger plant staff or cause a release to the environment.
