APPENDIX A NOTICE OF VIOLATION Public Service Electric and Gas Company Docket Nos.'50-272 & 50-311 Salem Nuclear Generating Station License Nos. DPR-75 & DPR-70 As a result of the inspection conducted on January 22, 1982, and in accordance with the NRC Enforcement Policy, 10 CFR 2, Apendix C, the following violation was identified:

10 CFR 71.5 prohibits delivery of licensed material to a carrier for transport, unless the licensee complies with applicable regulations of the Department of Transportation in 49 CFR, Parts 170-189. 49 CFR 173.392(c)(1) states,

" Materials must be packaged in strong, tight packages . . . ."

Contrary to the above, on January 21, 1982, a waste shipment of licensed material was delivered to a carrier for transport to the Chem-Nuclear Systems, Inc., burial site at Barnwell, South Carolina, by the licensee, and two of the one hundred fourteen 55 gallon drums were not strong, tight packages. The two drums, each containing 4.8 millicuries of licensed material, were inspected at the burial site on January 22, 1982, and the inspection revealed that one drum (No. 0083) had a three-inch slit in its side, and the other (No. 0047) had a small hole in its lower portion.

This is a Severity Level III violation. (Supplement V.C.1)

Pursuant to the provisions of 10 CFR 2.201, Public Service Electric and Gas Company is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been +aken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending your response time.
