Meeting Summary:
Holtec Decommissioning International (HDI) requested a clarification meeting with the U.S. Nuclear Regulatory Commission (NRC) staff to discuss the draft response to Request for Additional Information (RAI) request dated October 21, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22292A238) regarding the submittal, Amended and Restated Holtec Indian Point 2, LLC Master Decommissioning Trust Agreement for Indian Point Nuclear Generating Units 1 and 2, (Proposed Amended IP2 Master Trust Agreement) dated August 10, 2022 (ML22222A087). HDIs objective for the meeting was to inform the NRC staff on its re-submittal progress with the RAI responses, schedule for future amended trust agreement submittals, and provide an opportunity for the NRC staff to comment and communicate on any areas within the HDI proposed draft RAI responses.
The NRC staff discussed the concerns as related in the RAIs for the trust agreement and how they related to the other sites with HDIs future submittal schedule. HDI stated that the clarifications and improvements to Indian Point 2s amended trust agreement would be incorporated into other future site submittals.
HDI continued the discussion on how the RAI responses and changes to the amended trust agreement provided a consistent understanding, and pursuant of Title 10 of the Code of Federal Regulations 50.75(h)(1)(ii), Reporting and recordkeeping for decommissioning planning, as to the engagement of the Authorized Person along with an explanation of the Internal Revenue Service citations regarding the Permissible Assets as per Special Terms. The NRC staff stated the adjustments made to the amended trust agreement with the draft RAI responses appear to meet the NRCs understanding where HDI may submit a new formalized version. This supplement was provided to the NRC staff in ML22308A257.
The meeting was closed at 2:45 p.m., as HDI appreciated the NRC staff for the time and stated the clarification meeting was of great value continue with submitting the required RAIs.
