Dear Sir:

The New York Power Authority (NYPA) submits this Special Report in accordance with the requirements of Administrative Procedure AP-01.04, " Tech Spec Related

, Requirements, Lists, and Tables *". The Report identifies Fire Protection Features that, by plan, were rendered non functional to accommodate certain activities during_

the 1994/1995 Refueling Outage. While these features were non-functional, plant administrative controls were in place to ensure adequate fire protection _was provided.- .

INTRODUCTION:

The Fire Protection Program requirements were removed from Technical Specifications with Amendment 218 to the James A. FitzPatrick Operating License dated November 3,1994. Administrative Procedure AP-01.04 provides centrols for these Fire Protection Program requirements, lists, and tables previously included in Technical Specifications. If the non-functional Fire Protection Features cannot be restored to a functional status within 7 days, the procedure requires a written report to the NRC within 30 days outlining the action (s) taken, the cause for the non-functional Fire Protection Features, and plans and schedule for restoring the Fire Protection Features to a functional status. ]

Turbine Building HVAC System fire / carbon dioxide (COJ dampers 67CD-3 and 67CD-4, located in the East and West Electric Bays, were rendered non-functional on ,

February 23,1995 in support of plant modification M1-95-007. Immediate actions taken included establishing continuous fire watches for the unprotected areas.

An evaluation of CO2 protected areas at JAF determined that the East and West Electric Bays did not have adequate venting capability during discharge of the CO2 suppression systems. To correct this deficiency, fire /CO2 dampers 67CD-3 and 67CD-4, between the Electric Bays and Turbine Building, were modified to eliminate .

their automatic closure feature when CO2 discharge is initiated. Dampers were reclassified as fire dampers and assigned new system component identifications 67FD-1 and 67FD-9.

Due to the duration of the modification, dampers were not returned to a functional condition within the required restoration period.

EOUIPMENT RESTORATION:

Plant modification MI-95-007 was completed and fire dampers 67FD-1 and 67FD-9 were returned to a functional status on March 21,1995. ,
