NOTICE OF VIOLATION Italian' Body Shop General License (10 CFR 31.5) '

-Columbus,-Ohio Docket Number: 99990003

-As a result.of the telephone discussion with Jamnes Cameron on February 15, '

1994.and letters dated August 11, 1994 and October 5, 1994, and in accordance with the " General Statement of-Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the following violations were identified:

1. 10 CFR 31.5(c)(8) requires, in part, that any person who acquires,

' receives, possesses, uses or transfers byproduct material in a device

. pursuant to a general license shall, except as provided for in 10 CFR 31.5(c)(9), transfer.or dispose of the device containing byproduct material only by transfer to persons holding a specific license pursuant to'10 CFR Parts 30 and 32 or from an Agreement State to receive the device.

Contrary to the above, in February of 1994, the licensee transferred (lost) a device containing approximately ten millicuries of polonium-210, and this transfer was not made to a person holding a specific-license pursuant to 10 CFR Parts 30 and 32 or from an Agreement State to receive the device.

This .is a Severity, Level IV violation (Supplement VI).

2. 10 CFR 31.5(c)(10) requires, in part, that the licensee comply with provisions of 10 CFR 20.2201. 10 CFR 20.2201(b) requires, in part, that each licensee submit a written report to the NRC within 30 days after making a telephone report regarding the loss or theft of licensed material .

Contrary to the above as of August 10, 1994, the licensee did not submit l a written report to the'NRC within 30 days after making a telephone l report on February 25,1994 regarding the loss of ten millicuries of polonium-210 contained in a static eliminator device.

This is a Severity Level IV violation (Supplement IV and VI).

Since; Italian Body Shop no longer possesses licensed material and has no plans for future possession of licensed material, no reply to the violation is required.
