NOTICE OF VIOLATION  !

Wabash Magnetics Automotive Products Group Docket No. 999-0003 Huntington, Indiana General License (10 CFR 31.5)  !

1 As a result of the letter dated October 14,1998, and in accordance with the " General Statement I of Policy and Procedure for NRC Enforcement Actions," the violation is listed below:

l 10 CFR 31.5(c)(8) requires, in part, that any person who acquires, receives, possesses, uses, or transfers byproduct material in a device pursuant to a generallicense shall, except as  !

provided for in 10 CFR 31.5(c)(9), transfer or dispose of the device containing byproduct  !

material only by transfer to persons holding a specific license pursuant to 10 CFR Parts 30 and i 32 or from an Agreement State to receive the device.  ;

I Contrary to the above, in September 1998, the licensee transferred (lost) an anti-static air gun containing approximately 20 millicuries (mci) (740 MBq) of polonium-210, and this transfer was i not made to a person holding a specific license pursuant to 10 CFR Parts 30 and 32 or from an l Agreement State to receive the device.  !

This is a Severity Level IV violation (Supplement VI). i The NRC has concluded that information regarding the reason for the violation, the corrective -

actions taken and planned to correct the violation and prevent recurrence has already been ,

adequately addressed in your report of loss of the static control ionizer. However, you are l' required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions 'or your position. In that  ;

case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of

  • Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region ill, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

Director, Office of Enforcement, U.S. Nuclear Regulatory Commission, Washington, D.C.

Dear Sirs:

l This letter is to inform you that we have lost a static control ionizer. The model number of the ionizcr is P-2031, serial number 96781, and lease number 062464. The unit was supplied by NRD inc. NRD informed us we were required to report this loss along with the following ,

questions and answers.  !

1. How was the device used?

To reduce static build-up on silicon o-rings.

2. Where was the device used?  !

At the address listed in the footer below, in the Honda VN manufacturing cell.

3. When was it last used?

Approximately November 1997-May 1998.

4. What do you think happened to the device?

The device is mnst likely stored somewhere within the building. )

5. What efforts have you made to locate the dedee? i A thourough search of the area where it was used and a general search of the facility.
6. What has been done to prevent future loss?

We will no longer be using these devices, j i
