lJil NOTICE OF VIOLATION

- United States Enrichment Corporation Docket No. 70-7001 Paducah Gaseous Diffusion Plant Certificate No. GDP-1 During an NRC inspection conducted from May 29 through July 19,1999, one violation of NRC requirements was identified. In accordance with the ." General Statement of Policy and Procedure for NRC Enforcement Actions," Revision 1, the violation is listed below:

Technical Safety Requirement 3.9.1 required, in part, that written procedures shall be implemented for activities described in the Safety Analysis Report, Section 6.11, Appendix A.

The Safety Analysis Report, Section 6.11, Appendix A, identified quality assurance, including corrective actions, as an activity for which written procedures shall be implemented.

Procedure CP1-PO-SF1001, " Plant Shift Superintendent Communication," Revision 0, dated May 16,1996, required, in part, that the plant staff shall promptly notify the Plant Shift Superintendent of identified problems with Technical Safety Requirement-related systems, Procedure CP2-BM-Cl1031, " Corrective Action Process at Paducah Gaseous Diffusion Plant," Revision 1, Change A, dated March 18,1999, required, in part, that the plant staff shall notify the Plant Shift Superintendent immediately upon the identification of conditions which have the potential to be an operability or reportability concem.

Contrary to the above, between May 10 and June 1,~ 1999, the plant staff did not promptly notify the Plant Shift Superintendent of identified problems and conditions ,

associated with the process building fire protection systems which had the potential to  !

be either an operability or reportability concem. Specifically, the plant staff did not . notify !

the Plant Shift Superintendent of corrosion, observed during annual reappraisals and reviews of the systems, on sprinkler heads associated with the Technical Safety  !

Requirement-related process building fire protection systems.

This is a Severity Level IV violation (Supplement VI). (VIO 70-7001/99008-02). '

Pursuant to the provisions of 10 CFR 76.70, United States Enrichment Corporation is hereby required to submit a written statement or explanation for Violation 70-7001/99008-02(DNMS) to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C.

20555, with a copy to the Regional Administrator, Region lil, and a copy to the NRC Resident inspector at Paducah, within 30 days of the date of the letter transmitting this Notice of Violation

' (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation,-(2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Notico of Violation docketed correspondence, if the correspondence adequately addresses the required response.

If an adequate reply is not received within the time specified in this Notice, an Order or a

. Demand for Information may be issued as to why the Certificate should not be modified, suspended, or revoked, or why such other action, as may be proper, should not be taken.

Where good cause is shown, consideration will be given to extending the response time.
