.This refers to your telephone discussion with Jamnes Cameron on February 25, 1994 and-your letters dated August 11, 1994 and October 5,1994, notifying NRC Region III:0ffice of the loss of a polonium-2IO static elimination device.
The device, Model P-2051, Serial Number 64467, is manufactured by NRD, Inc.,
and contains a nominal 10 millicuries of polonium-210. On February 22, 1994, lthe device was discovered missing. Interviews'with employees and-search efforts to-recover the missing device proved unsuccessful.
LAfter reviewing this incident,.two. violations of NRC requirements were identified.. The violations involve the' unauthorized ' transfer 'of approximately -
ten' millicuries of polonium-210 and failure to provide.a written report to the NRC within 30 days after making a telephone report of theft or. loss of licensed material. .The. violations.are described in the enclosed Notice of 'i P Violation.;

- Although; the amount of material discarded wasismall, the violations I. '
9 ' demonstrate the~importance.of maintaining. adequate control of all radioactive
[ material'to ensure that improper handling or disposal does not occur. Your.
letter dated October 5,'1994. Indicates':that Italian Body Shop:no longer. has
- possession ~ of radioactive materials authorized for use by the NRC and does not-intend to possess any'in the future. Consequently, no ~ reply to the violation
.-is required _and we haveLno further questions regarding this matter. We
' caution you,however, that any similar violation will carry increased significance and may result in escalated enforcement action, including imposition of monetary penalties.
- If your current situation changes and licensed material is needed,,you are
' hereby required to submit a written statement to the U.S. Nuclear Regulatory Commission, Region III, 801 Warrenville Road, Lisle, Illinois 60532-4351,
. within 30. days prior to receiving licensed material. This reply should s: 1 -discuss the controls you will' institute to prevent future losses of
~
! radioactive material.
In' accordance'with 10 CFR 2.790 of the Commission's regulations, a copy of
