subject inspection report. The violation serves as another example of the slow recovery of your I ISI program.

You are requned to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with j l regulatory requirements. -

e i NOTICE OF VIOLATION Commonwealth Edison Company Docket Nos. 50-254;50-265 Quad Cities Station, Units 1 and 2 License Nos. DPR-29; DPR-30 During an NRC inspection completed on December 18,1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC .

Enforcement Actions," NUREG-1600, the violation is listed below: l l

Quad Cities Technical Specification 4.0.E requires that the " inservice inspection of ASME Code Class 1, Class 2, and Class 3 components ...shall be performed in l

accordance with Section XI of the ASME Boiler and Pressure Vessel Code and j applicable Addenda as required by 10 CFR 50, Section 50.55a(g)." '

10 CFR 50.55a(g)(5)(iv) requires "Where a.i examination requirement by the Code or l addenda is determined to be impractical by the licensee and is not included in the l revised inservice inspection (ISI) program as permitted by paragraph (g)(4) of this section, the basis for this determination must be demonstrated to the satisfaction of the Commission no later than 12 months after the expiration of the initial 120-month period of l operation and each subsequent 120-month period of operation during which the l examination is determined to be impractical."  !

l Contrary to the above, as of December 18,1998, the licensee had not included in a revised ISI program nor demonstrated to the satisfaction of the NRC, the basis for their determination that the Code required examination was impractical for the Unit 2 reactor pressure vessel (RPV) nozzle weld N8B, the Unit 1 RPV nozzle weld N1 A, and the recirculation system tee to valve weld 02BS-F6.

This is a Severity Level IV violation (Supplement I). (50-254/98021-01; 50-265/98021-01)

Pursuant to the provisions of 10 CFR 2.201, Commonwealth Edison is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk,' Washington, D.C. 20555 with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident inspector at the Quad Cities Nuclear Generating Station, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This j reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation or severity level, (2) the corrective steps that havs been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may ieference or include previous docketed correspondences, if the correspondence adequately addresses the requl red response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.

If you contest this enforcement action, you should also provide a copy of your response, with the basis for your denial, to the Director, Office of Enforcement, United Stateo Nuclear Regulatory Commission, Washington, DC 20555-0001.

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so -

that it can be placed in the PDR without redaction. If personal privacy or proprietary information

'is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a redacted copy of your response that deletes such information. If you request withholding of such material, you_mynt specifically identify the portions of your response that you seek to have withheld and provide in detail the bases for your claim of withholding (e.g., explain why the disclosure of information will create an unwarranted invasion of personal privacy or provide the information required by -

10 CFR 2.790(b) to support a request for withholding confidential commercial or financial information). _ If safeguards information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21.

In accordance with 10 CFR 19.11, you may be required to post this Notice within two working days.
