MASSACHUSETTS ATTORNEY GENERAL JAMES M. SHANNON'S MOTION TO FILE PROPOSED FINDINGS OF FACT AND RULINGS OF LAW ON SHELTERING CONTENTIONS LATE For the reasons set forth below, the Massachusetts Attorney General ("Mass AG") submits this motion to file Proposed Findings of Fact and Rulings of Law on Sheltering Contentions (hereinafter "Findings") late.

1. On Friday afternnoon, August 12, 1988, the date when the Findings were due, the WANG system at the Mass AG's office was down due to electronic malfunction.

2. The final draft of the Findings could not be p inted due to this malfunction.

3. The attorney for the Applicants in this case has assented to receive a copy of the Findings on Monday, August 15, 1988.

4. The Off-Site Licensing Board ("the Board") was called and a message was left regarding the aforementioned situation.

5. The Findings will be sent by Federal Express to the Board and copies will be delivered to all parties on the service list on Monday, August 15, 1988, after the WANG system is back on line.
