Dear (Mr.Latimer:

SUBJECT:

ALLEGATION. REPORT RII-93-A-0125 This refers to your letters to the Nuclear Regulatory Commission (NRC) dated May 25, 1993 and June 27, 1993. We apparently did not receive your first letter when it was originally sent. You have expressed the concern of being terminated from Carolina Power and Light (CP&L) in November 1992 as a direct result of bringing complaints to the NRC concerning the erosion and corrosion i

program at CP&L's H.B. Robinson facility. In addition, you have alleged poor engineering by CP&L's corporate engineering a'"ce rc.ated to the design of new and replacement systems that resulted in premature failure and replacement due to wear in numerous cases. This latter concern lacks specificity. Any details that you can provide would be appreciated to facilitate our inspection follow-up.

We have initiated actions to develop and examine the facts and circumstances of your concerns. We will forward to you our inspection findings once the inspection is completed.

You have stated that you were terminated from CP&L as result of bringing complaints to the NRC. This is a discrimination complaint. Although it appears that the time to file a discrimination complaint with the Department of Labor (DOL) has lapsed (180 days of the occurrence), we are nevertheless advising of your right to file a complaint with D0L whenever you believe that you have been discriminated against for bringing safety concerns to the NRC.

Send complaints to:

Office of the Administrator Wage and Hour Division Employment Standards Administration Room S3502 U.S. Department of Labor 200 Constitution Avenue, NW Washington, DC 20210 ,

or any local office of the Department of Labor, Wage and Hour Division. Check your directory under U.S. Government listings.
