Gillespie, Director Program Management, Policy Development and Analysis Staff Office of Nuclear Reactor Regulation United States Nuclear Regulatory Commission Washington, D.C. 20555

Dear Mr. Gillespie:

This is in further reference to the settlement negotia-tions in progress between Alabama Electric Cooperative and Alabama Power Company, which were the subject of letters to you dated June 17, 1988 and your responses dated June 29, 1988.

On behalf of Alabama Electric Cooperative, this will inform you that since June 17 serious settlement negotiations have been continuously in progress. Drafts of a proposed Memorandum of Understanding have been exchanged and discussed, and the next meeting to review them, in the light of further revisions now being worked on, has been scheduled for August

10. The progress in the negotiations has been sufficiently good so that both parties consider it to be probable that a mutually agreeable settlement will be reached, and both parties hope that a definitive Memorandum of Understanding can be completed and signed by Labor Day and possibly a little sooner.

Accordingly, it is requested that the Commission defer further action in the matter, with the understanding that the parties will submit a further report to you by Thursday, September 15, 1988.

It is our understanding that a similar letter is being sent to you on behalf of Alabama Power Company.

Sincerely yours 8808050157 800727 PDR ADOCK 05000348 PNU FA '
