INTERVENORS' MOTION FOR AN EXTENSION WITHIN WHICH TO FILE RESPONSE l l

The Intervenors move this Board to allow a'one day f extension within which to file their response to the Appeal Board's Orders dated June 22, 1990 and July 17, 1990. As grounds for this motion the Intervenors state: j r

'1 1. On August 6, 1990 at approximately 3:15 - 3:30 p.m. 1 the word processing system at the Massachusetts Attorney i General's (" Mass AG") offico ceased to function. The Intervenors' response was being transcribed on the system when this occurred. All terminals on the office wide word processing system were frozen and than shut.down.

2. The Mass AG was informed by the contractor who was summoned to repair the system that there was no way of knowing how'long the system would be shut down or whether the documents s

that had been on screen when the system crashed would be lost.

3. Whon tha word proc 320ing cyctca finally e2co back on line, the Mass.AG 1 earned that approximately half the document had been erased due to the malfunction. The Mass-AG then rewrote the document as quickly as was practicable, and it is filed with this motion.

Wherefore, the Intervenor's request that the Board grant this motion and allow the late filing of the accompanying response..
