4 In the Matter of )
FLORIDA POWER S LIGHT COMPAtlY ) Docket No. 50-389 (St. Lucie 'luclear Power Plant, )
U n i t flo . 2 ) ) s POTION TO PERMIT DISCOVERY Intervenors obtained copies of ALA3-537 for the first time on Friday, April 6, 1979, while visiting 'lRC offices in 3ethesda,:td.,
when William D. Paton, Esquire of DELD provided a copy of that document to Counsel for intervenors.
Coincidentally, Intervenors learned and subsequently confirmed, that on the very date, April 5,1979, that ALAB-537 was ordering addition-al hearings on electrical grid stability problems in the FPL systems, Florida Power and Light Compan.v was experiencing what apoarently has become its " third annual spring electrical blackout."* (See attac' d
'4 i am i Merald articles of April 5,1979 and April 6,1979.)
Indeed, Joe Johnson, an engineer for the Florida Dublic Service Commission stated," Florida is becoming known in electrical circles as the blackout capital of the worl d." (See the "iami Herald article of April 6, 1979, attached herein.)
Presently, counsel for intervenors is busy preoaring a petition fo r Writ of Certiorari to the U.S. Supreme Court asking that Court to review decisions arising from the f ailure of the Nuclear Regulatory Commission to consider Class 9 accidents in the 'IEPA siting revier for the St. Lucie Unit 2 nuclear power reactor on pooulous !iutchinson Island, as uoheld
- Florida Power and Light ComDany eXDerienC?d Drevious Consecutive annual systemwide blackouts on May 16, 1977 and '!ay 14, 1973 during the spring season respectively. There has been additionally in the FPL system a varied history of many blackouts during the decades of the 1970's and late 1960's.

by the U.S. Court of Appeals for the District of Columbia Circuit in a final Order filed January 30, 1979. Upon completion of that effort, and after May 1, 1979, Intervenors would wish to avail themselves of discovery on the electrical grid instability and emergency power systems issues as is their right under 10CFR Part 2 af the Commissions Rules of P ractice.
Therefore, pursuant to 10CFR 2.741 Intervenors motion that they be granted leave to obtain production of documents and things and entry upon land for inspection and other purposes.
Specifically, Intervenors ask that, as is allowed by 10CFR 2.741(a)(1),
they be permitted to inspect and copy all documents and tangible things in the possession of and pertaining to the electrical grid stability and emergency powa. systems of the Florida Power and Light Company.
Pursuant to 10CFR 2.740(b),. Intervenors ask that they be granted leave to propound interrogatories to the Florida Power and Light Comoany concerning electrical grid stability and emergency power systems in the FPL systems.

CERTIFICATE OF SERVICE I hereby certify that copies of the "Mo'. ion to Permit Discovery" have been served on the following by deposit in the U.S. Mail on this
