Act on the basis of the Fif th Circu' t decision in Gainesvil Utilities Department v. Florida Power & Light Co., 573 F.2d 292, 294 (5th Cir.), cert. denied 439 U.S. 966 (1978).

The Commission has previously considered this question, and concluded by Order dated December 21, 1979, that it would await the completion of further proceedings then pending in the Gainesville case before determining whether the initiation of Section 105a proceedings before this Commission would be warranted. That Order of the Commission was appealed by certain of the Movants to the United States Court of Appeals for the District of Columbia Circuit, where it is now pending.

Gainesville litigation have now been completed and resolved via settlement, and the case has been dismissed by Order of the Court dated August 4, 1981, and FPL believes that a rejection of Movants' request for 105a proceedings would now be timely.

FPL's response to the instant Motion is due on September 11, 1981. FPL hereby respectfully requests a brief extension of time until September 16, 1981. This extension of time is requested due to the press y. filings required of counsel for FPL by the Licensing Bo2rd in Docket No.50-389A, and in order to permit evaluation of the effects of the Gainesville settlement on the pending appellate proceedings.-1/

Counsel for Movant cities has authorized the undersigned to state that Movants have no objection to the granting of this extension.

Accordingly, FPL requests that the time for filing its response to Cities' Motion to Establish Procedures be extended to September 16, 1981.

The Court of Appeals has been informed of the Gainesville settlement by motion of appellant Cities dated August 25, 1981.
