i MASSACHUSETTS ATTORNEY GENERAL'S NOTION FOR CLARIFICATION REGARDING LBP-89-28

The Massachusetts Attorney General hereby requests clarification of this Board's Order of November 14, 1989 regarding LBP-89-28, the Licensing Board's Memorandum and Order rejecting all of Intervenors' low power testing contentions, as follows:

1. This Board was established as a separate appellate board "to hear any appeals from the portion of this operating l-license proceeding concerned with motions to reopen for consideration of low power testing contentions." November. 14 Order at 2.

2. By its November 14 Order, this Board deemed the I

previously filed Intervenor notices of appeal of LBP-89-28 as

" adequate", order at 2, and, apparently, to be considered as t filed as of November 14. Id. Pursuant to 10 C.F.R. 52.762,

  • Mass AG therefore understands its brief on LBP-89-28 should be i filed with thin Board 30 days thereafter, or by December 14, 52.762(b)
3. Also by the November 14 Order, however, this Board expressed the " tentative view" that LBP-89-28 was n21 ,

separately appealable and that LBP-89-28 "is clearly appealable now as cart of any aceeal of the initial decisiori (LBP-89-32)." November 14 Order at 2. This suggests that the appeal brief of LBP-89-28 should be filed with the other appellate board considering LBP-89-32, that the Mass AG's ,

discussion of LBP-89-28 concerning low power contentions should be filed as part of his appeal brief of LBP-89-32, and that this brief, including the discussion of LBP-89-28, is not due t

until December 22, in view of Mass AG's notice of appeal of LBP-89-32 filed on November 22. See $2.762 (b) .

In these circumstances, Mass AG requests this Board to clarify:

a. the appellate board with which Mass AG should file its appeal brief of LBP-89-28 concerning low power l contentions; i
