SURRY INDEPENDENT SPENT FUEL STORAGE INSTALLATION -

TEMPORARY MODIFICATION OF IMPLEMENTATION OF U.S. NUCLEAR REGULATORY COMMISSION ORDER EA-02-104

Dear Mr. Stoddard:

By letter dated January 3, 2018, Virginia Electric and Power Company (Dominion) requested a one-time modification from specific interim compensatory measures (ICMs) listed in the U.S.

Nuclear Regulatory Commission (NRC) Order EA-02-104 for the Surry Independent Spent Fuel Storage Installation (ISFSI). Dominion indicated that due to the presently predicted weather conditions and the concern for security personnel safety, it might be necessary to modify implementation of several of the ICMs contained in the Order. Specifically, Dominion proposed a one-time temporary modification to the implementation of its response to ICMs C.1.b, C.3.a(1), and C.3.d of the Order.

The NRC concluded that Dominions proposed one-time modification to the ICMs contained in NRC Order EA-02-104 for the Surry ISFSI reflects good cause given the anticipated weather conditions, and is therefore acceptable. We understand, per Dominions commitment in its January 3, 2018, letter referenced above, that Dominion will report any suspension of security measures related to the Surry ISFSI in accordance with the provisions of Title 10 of the Code of Federal Regulations 73.71. The NRC also understands that the contingency plans proposed by Dominion will no longer be implemented once the severe weather condition has passed.
