DOMINION ENERGY REQUEST FOR RELAXATION OF SECURITY ORDERS FOR THE INDEPENDENT SPENT FUEL STORAGE INSTALLATIONS AT KEWAUNEE, MILLSTONE, NORTH ANNA AND SURRY POWER STATIONS

Dear Mr. Bischof:

On November 28, 2018 (Agencywide Documents Access and Management System Accession No. ML18334A107), Dominion Energy requested that the U.S. Nuclear Regulatory Commission (NRC) grant a permanent relaxation of the Security Orders for the independent spent fuel storage installations (ISFSIs) at Kewaunee Power Station (EA 07-195), Millstone Power Station (EA 03-173), and North Anna Power and Surry Power Station (EA 02-104). In the letter, Dominion Energy specifically requested that the NRC grant this relaxation to allow the use of appropriate compensatory measures and suspension measures provided in NRC-approved Physical Security Plans as an alternate means of compliance with the applicable interim compensatory measures or additional security measures issued for the ISFSIs under Orders EA 07-195, EA 03-173, and EA 02-104.

The NRC has reviewed Dominion Energys request for the relaxation of the Security Orders.

The NRC staff concludes that granting this relaxation from Orders EA 07-195, EA 03-173, and EA 02-104 would continue to ensure reasonable assurance of adequate protection of public health and safety and is consistent with the NRCs regulations in Title 10 of the Code of Federal Regulations 73.55(o) and (p), Requirements for Physical Protection of Licensed Activities in Nuclear Power Reactors Against Radiological Sabotage. Therefore, the NRC finds that good cause exists to relax Orders EA 07-195, EA 03-173, and EA 02-104 such that: (1) the licensee may apply the compensatory measures set forth in its NRC-approved Physical Security Plans during planned maintenance, construction projects, or inoperable security equipment; and (2) the licensee may follow the procedures set forth in its NRC-approved Physical Security Plans to suspend any security measures in the Orders in an emergency when this action is immediately
