Dcs June 30, 1986 EN 85-55A 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Duke Power Company Catawba, Units 1 and 2 Docket Nos. 50-413 and 50-414

IMPOSITION OF CIVIL PENALTY - $20,000 By EN 85-55 dated August 13, 1985, the Commission was notified that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Sixty-Four Thousand Dollars ($64,000) would be issued to Duke Power Company. This action was based on alleged discrimination against an employee for engaging in a protected activity. The Atomic Safety and Licensing Board during an operating licensing proceeding found that a QC welding inspector at the Catawba Nuclear Station, Clover, South Carolina was poorly rated in his 1982-83 performance appraisals because of his and his crew's expression of nuclear safety concerns to management.

The licensee responded to the Notice in a letter dated October 1, 1985. After careful consideration of the licensee response, the staff has concluded that

( the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty but that a sufficient basis exists for reduction of the severity level of the violation from a Severity Level II to a Severity Level III. Further, the staff has concluded that the proposed civil penalty should be mitigated in recognition of the licensee's prompt and extensive corrective actions at the Catawba Nuclear Station. Accordingly, an Order Imposing a Civil Monetary Penalty in the amount of Twenty Thousand Dollars has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.

A news release has been prepared and will be issued after the licensee is notified.
