IMPOSITION OF CIVIL PENALTY - $75,000 By EN 89-53 dated May 16, 1989 the Commission was notified of the intent of-DE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Seventy-five Thousand Dollars ($75,000) to Duke Power Company (Catawba). This action was based on violations involving an inoperable Unit 2 Containment Air Return Hydrogen Skimmer Train caused by a design modification wiring error and the licensee's failure to report a condition prohibited by technical specifications.

The licensee responded to the Notice in a letter dated June 16, 1989 admitting the violations, but requesting mitigation. After careful consideration of the licensee's response, the staff has concluded that the violations occurred as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty, and that mitigation was not warranted.

Accordingly, an Order Imposing Civil Penalty in the amount of $75,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the fate of the Order, pay the civil penalty or request a hearing.
