August 13, 1985 EN 85-55 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Duke Power Company Catawba Units 1 and 2 Docket Nos. 50-413 and 50-414

PROPOSED IMPOSITION OF CIVIL PENALTY - $64,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Sixty-four Thousand Dollars

($64,000) will be issued on or about August 13, 1984 to Duke Power Company.

This action is based on alleged discrimination against an employee for engaging in a protected activity. The Atomic Safety and Licensing Board during an operating licensing proceeding found that a QC welding inspector at the Catawba Nuclear Station, Clover, South Carolina was poorly rated in his 1982-83 performance appraisals because of his and his crew's expression of nuclear safety concerns to management. This is a violation of 10 CFR 50.7.

It should be noted that although the licensee has not been specifically informed of the enforcement action, the Director, Office of Inspection and Enforcement discussed this action in a Director's Decision under 10 CFR 2.206 (DD 85-9) issued June 4, 1985. The Commission has declined to take review of that decision under 10 CFR 2.206(c). The schedule of issuance and notification is:

Mailing of Notice August 13, 1985 Telephone Notification of Licensee August 13, 1985 A news release has been prepared and will be issued about the time the licensee receives the Notice. The State of South Carolina will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
