IRTIFlHI MINUTES OF THE 458TH MEETING OF THE ADVISORY COMMITTEE ON REACTOR SAFEGUARDS DECEMBER 3-5,1998 ROCKVILLE, MARYLAND The 458th meeting of the Advisory Committee on Reactor Safeguards was held in Conference Room 2B3, Two White Flint North Building, Rockville, Maryland, on December 3-5,1998. The purpose of this meeting was to discuss and take appropriate action on the items listed in the attached agenda. The meeting was open to public attendance. There were no written statements nor requests for time to make oral statements from members of the public regarding the meeting. ,

Dr. Robert L. Seale, Committee Chairman, convened the meeting at 8:30 a.m. and reviewed the schedule for the meeting. He announced that there is an important set of meetings between the Commissioners and Members of Congress coming up toward the end of January 1999. Dr. Seale stated that at the end of January the Committee will have an " Extended Planning and Procedures Subcommittee" meeting involving all Committee Members. There are several issues that will be included in that meeting that the Commissioners requested input from the Committee. A report communicating these issues will be forwarded to the Commission instead of a letter. Other items of interest mentioned were several different speeches by the Commissioners and changes in the NRC staff personnel including the retirement of Hugh L. Thompson, Jr. In February, the full Committee will meet with the Commissioners.

Introduction Dr. Thomas S. Kress, Chairman of the Regulatory Policies and Practices Subcommittee, introduced the presentation by noting that the NRC staff met with joint ACRS Subcommittees on November 19,1998. During the meeting, the staff presented NRC staff and industry positions regarding the overall objectives and options for making 10 CFR Part 50 risk informed. Dr. Kress stated that the Committee was in the early stages of evaluating this matter.
Staff Presentation Messrs. Mark Cunningham, Office of Nuclear Regulatory Research (RES), and Richard Barrett, Office of Nuclear Reactor Regulation (NRR), introduced the staff presentation concoming a proposed Commission paper regarding options for making 10 CFR Part 50 risk-informed. They presented the staffs objectives and desired outcomes of modifying Part 50, the elements of the modification, and the criteria for assessing options. Mr. Barrett presented three policy and seven implementation issues associated with modifying Part 50. They summarized the benefits and impacts of the proposed options, described the associated resource issues, and explained the role of the Nuclear Energy Institute (NEl) Whole Plant Study.
The staffs preliminary recommendations included implementing a phased approach for modifying Part 50, issuing exemptions to pilot plants, and developing a detailed rulemaking plan. Mr. Barrett concluded by presenting the schedule for issuing the draft Commission paper.
The ACRS Members and the staff discussed the following issues possible use of core damage frequency (CDF) and large, early release frequency (LERF) in making Part 50 risk informed; 2

Ill. Proposed Ootions to Make 10 CFR 50.59 Risk-Informed (Open)

.Dr. George Apostolakis, Chairman of the Subcommittee on Reliability and Probabilistic Risk Assessment (RPRA) introduced the topic to the Committee. He stated that the purpose of this meeting was to discuss the staff's development of options to make 10 CFR 50.59 (Changes, Tests and Experiments) risk-informed.
! He noted that the Subcommittees on RPRA, Plant Operations and Regulatory Policies and Practices had met on November 19,1998, to discuss these matters. -
Dr. Apostolakis also noted that several ACRS Members had prepared comments and questions for the staff to consider in preparing for this briefing.
'NRC Staff Presentation I i l Ms. Mary Drouin and Mr. Jack Guttmann, RES, led the presentation for the NRC l staff. Ms. Eileen McKenna, NRR, provided supporting discussion. Mr. Mark Cunningham, RES, also participated. The staff discussed a draft paper from RES to NRR that provides a summary of options for making 10 CFR 50.59 risk-informed, l
examples of changes which consider the use of risk criteria, and a test case 3
458th ACRS Meeting December 3-5,1998 i regarding the reclassification of the South Texas Project essential cooling water screen wash booster pump. The staff made the following significant points during their presentation:
The draft paper is a work-in-progress and requires significant revision. The staff requested to meet with the Subcommittees in January 1999 and requested a Committee report during the February 1999 ACRS meeting.
Key areas for possible change include: the scope (related to the FSAR and technical specifications) and parameters (related to determination of ,
unreviewed safety questions). Options for modification include: no change, i scope change only, parameter change only, and scope and parameter i changes.
Dr. Wallis questioned the basis for the options considered by the staff and suggested that the objectives be stated earlier in the report. Dr. Miller agreed and stated that there did not appear to be a clear set of objectives. Dr. Apostolakis j suggested that the staff consider a bolder approach in evaluating the options and I in considering the issue of combined changes. The staff agreed to consider these comments in revising the draft paper.
Dr. Wallis suggested that the staff better define terms such as safety status, adequate protection, defense-in-depth, safety margins, and operational safety so that they can be used in a more formal way to discuss and evaluate the options.
The staff stated that these terms have different levels of use and meaning, and acknowledged that better definition would be beneficial.
Dr. Apostolakis questioned the extent that the staff had evaluated the use of frequency-consequence curves. The staff stated that they did not have sufficient time to evaluate this previous ACRS suggestion.
Dr. Wallis suggested that the staff consider more than one test case in evaluating the options. The staff acknowledged that this would be beneficial but noted that good test case examples were very difficult to find.

IV. Intearated Review of Assessment Processes and imorovements to the Senior Manaaement Meetina Process (Open)

Introduction Mr. John Barton, Chairman of the Subcommittee on Plant Operations, introduced I this topic to the Committee. ' He noted that the purpose of this meeting discussion was to review the proposed changes to the NRC inspection and assessment
_ program, including the IRAP, the SMM process, development of a risk-informed baseline inspection program, and performance indicators (Pis). A joint meeting of
' the Reliability and Probabilistic Risk Assessment,' Plant Operations, and Regulatory Policies and Practices Subcommittee was held on November 20,1998 to review these matters. i Mr. Barton noted that the Commission has requested formal comment from the ACRS on the status of its review during this meeting. As such, an Interim Report, ;
based _on the results of these discussions, will be drafted for Committee consideration. Mr. Barton said that the Committee plans to continue its review of this matter during its February meeting, with the expectation that a final report can be prepared at that time.
NRC Staff Presentations Mr. Michael Johnson, NRR, noted that the staff had established three Task Groups to develop the new NRC Performance Assessment Program. These are the Framework, Risk-Informed Baseline Inspection, and Assessment Task Groups.
Each group's charter was also noted.
The status of the Framework Task Group efforts was discussed by Mr. Patrick l Baranowsky (AEOD). The scope of the framework approach includes the l

the identification and evaluation of performance indicators (Pis), identification of supplemental inspection areas, and, the evaluation of performance thresholds.
Specific topics discussed included: the relationship of the Pls and risk-informed inspection, development of specific Pls and their evaluation, supplemental inspection areas, so-called Cross-Cutting Issues for consideration in evaluation of performance, licensee performance levels (green, white, yellow, and red) and the risk-informed evaluation of same, and bench marking of the Pis.
In response to a question by Dr. Powers, the staff noted that the Pls for shutdown operations are still under development. Dr. Apostolakis requested a copy of the staff's analysis used to develop the numerical values of the Pls that delineate the performance level thresholds (e.g., the green-to-white threshold).
Dr. John Flack (RES) briefly outlined the RES research activities associated with development of risk-informed, performance-based inspections. The key issues involved, approaches (generic and plant-specific) taken, and recommendations on development of this inspection process were noted.
An outline of the risk-informed baseline inspection program was discussed by Mr.
Bruce Mallet, NRC Region 11 Office. The key concepts of the proposed program include the following:
e Inspectable areas are defined based on linkage to Safety Comerstone attributes; e Basis documents for inspectable areas includes risk-based rationale; e Program includes: inspection of areas defined that are not bounded by Pls, verification of the Pls, and review of licensee effectiveness of problem identification and resolution; e Planning process for inspections based on a 12-month assessment period; e Feedback mechanism included to adjust level of inspection effort.
Dr. Powers suggested that NRC evaluate licensee problem identification and resolution as a trending indicator. Dr. Seale noted that use of a feedback 6
1 458th ACRS Meeting December 3-5,1998 mechanism is important. In response to a question from Dr. Seale, NRR stated that they had discussed inspection experience obtained in other industries for relevant lessons-learned.
' Mr. Johnson presented a brief overview of the assessment process development. '
He discussed the review mechanism for assessment of the safety cornerstones as well as the proposed action matrix that is to govem the response and i communication activities of the NRC, given both acceptable and degrading licensee l performance levels. Mr. Johnson noted, in response to Dr. Wallis, that the NRC is ;
attempting to enhance communication with the public relative to its understanding oflicensee performance, and that the staff will brief representatives at the state level ,
on the assessment process. Mr. Johnson also briefly addressed the details of the transition plan for implementation of the new assessment process.
Dr. Apostolakis expressed concem that the Commission had terminated human factors research, in light of the need for evaluation of a licensee's safety-conscious work environment. Mr. Barton suggested that the staff evaluate the licensee's root-cause analysis program to address this concern. Mr. Mallet indicated that the staff will give consideration to this issue. l NEl Presentation Mr. Steven Floyd, NEl, provided comment on the NRC revised plant assessment process. Key points included:
e NRC is to be commended for the quality, quantity and professionalism of its
. work on this matter. NEl and NRC have had an open and frank exchange of views.
e The revised assessment process will be a major improvement - it is risk-informed and more objective than the present assessment program.
e There is no need for a " problem identification and resolution" inspection in addition to the baseline inspection program. Mr. Mallet, in response, noted that the staff has committed to provide justification for this additional inspection effort.

V. Election of Officers for Calendar Year 1999 (Open)

The Committee elected Dr. Dana A. Powers as Chairman; Dr. George Apostolakis as Vice-Chairman; and Dr. Thomas S. Kress as Member-At-Large for the calendar year 1999.

The Committee held discussionk on potential items for the February 3,1999, scheduled meeting with the NRC Commission. Topics include proposed revisions to 10 CFR 50.59 (Changes, tests and experiments), options to make 10 CFR Pa:t 50 risk informed, status of ACRS activities associated with license renewal, proposed rulemak'ing on the use of revised source term, use of PRA insights in the regulatory process, elevation of core damage frequency (CDF) to a fundamental safety goal and possible revision of the Commission's Safety Goal Policy Statement, and the NRL Safety Research Program.

. 458th ACRS Meeting December 3-5,1998 Dr. Kress, Acting Subcommittee Chairman, Plant License Renewal Subcommittee, briefed the Committee regarding the November 18,1998, Plant License Renewal Subcommittee meeting. The focus of the meeting was in three areas: the status of two app'ication reviews (Calvert Cliffs and Oconee); the on-going and planned reviews of license renewal technical reports; and the resolution process for some identified generic license renewal issues.
The NRC staff will issue a draft safety evaluation report (that includes open itema) for each applicant and a subsequent supplemental safety evaluation report to close all open items. The ACRS is scheduled to start its deliberation on final reports in February 2000, and May 2000, for Calvert Cliffs and Oconee plants, respectively.
The processing of license renewal applications is being aided by the B&W Owners Group (BWOG) and the Westinghouse Owners Group (WOG) development of a series of;echnical reports on the management of aging effects. These are separate reporta for the various "in-scope" structures and components subject to an aging management review. As noted in the rule, these are specifically those structures and components that perform an intended function with moving parts or without a change in configuration or properties (i.e., passive) and those that are not subject to replacement based on a qualified life or specified time period such as reactor vessel, pressurizer, containment, steam generators, and reactor coolant system piping.
The staff has identified 98 license renawal issues that are generic in nature. The staff has used judgment to prioritize these into four categories of descending priority:
- 1. Resolution required to support the staff's review of an application.
- 2. Important to the development of the review and application process.
- 3. Non-generic and generic issues important but not important enough to include in (2) above.
- 4. Those issues recommended by NEl to be low priority.
The result of the prioritization is that there are 18 issues in category 1; 24 issues in category 2; 48 issues in category 3; and 8 issues in category 4 The staff is focusing on the Category 1 issues in the current review schedule.

.458th ACRS Meeting December 3-5,1998 The license renewal activities are conducted in a traditional manner in which the original licensing basis is to be preserved along with its defense-in-depth provisions.
The only risk-informed considerations are those that already exist in the current regulatory structure.
The Committee discussed future plans that include several subcommittee meetings and will develop a review strategy at its retreat meeting in January 1999.
Vill. ACRS Report to the Commission on the NRC Safety Research Prooram (Open)

Dr. Uhrig, Chairman of the Safety Research Program Subcommittee, discussed the need for the Office of Nuclear Regulatory Research (RES) to better focus and prioritize its efforts on " mission needs of the Agency." Likewise, Dr. Uhrig stated that the ACRS should focus its review on research that it believes to be paramount and that will continue to serve the Agency's needs. Some candidate areas of focus include;
. Risk-informed, performance-based regulation,
.- High-bumup fuel performance and core-power uprates,
. Thermal-hydraulics code integration,
. Advanced instrumentation and controls,
. Plant life extensions and decommissioning.
Follow-up efforts include discussion at the ACRS retreat in January 1999 and full Committee discussion during the February through April 1999 meetings, with a final repart to be issued to the Commission in May 1999.

e The Committee discussed Chairman Jackson's response dated November 10,1998, to the ACRS comments and recommendations included in the ACRS report dated September 30,1998, conceming the impact of PRA results and insights on the regulatory system.

i 458th AORS Meeting December 3-5,1998 e The Committee discussed the response from the EDO dated November 27,1998, to the ACRS comments and recommendations included in the ACRS letter dated October 16,1998, concerning Proposed Priority Rankings of GSis, Tenth Group.
The Committee decided to continue its discussion of several issues (e.g., resolution of the Multiple System Responset Program issues and reevaluation of the GSI process) at future meetings.
B. Report on the Meeting of the Planning and Procedures Subcommittee The Committee heard a report from Dr. Seale and the Executive Director, ACRS, on the Planning and Procedures Subcommittee meeting held on December 2,1998. The following items were discussed:
- All Members shouid have received the new Citibank Visa Card for Govemment Travel and should have destroyed their American Express cards.
e The Committee approved the final agenda for its January 27-29, 1999, Planning and Procedures Subcommittee meeting.
e The Charter of the Quadripartite Working Group on Reactor Fuels was completed and has been forwarded to the Advisory Committees of the other three countries. ACRS is stillwaiting forthe names of the foreign delegates to be submitted for membership to this Working Group from France and Germany. The Japanese have provided the name of an individual to serve on the Working Group, along with their views on the objectives for the Working Groups. The Subcommittee recommended that Dr. Apostolakis give a status report on the Working Groups on PRA and Human Factors.
e A letterwas prepared and forwarded to Mr. Bob Christie, Performance Technology, Inc., and to the EDO in response to Mr. Christie's letter of October 9,1998 e Members were requested to review the ACRS 1999-2000 Operating Plan and to make comments by January 16,1999.

458th ACRS Meeting December 3-5,1998 e The American Jewish Congress addressed a letter to Dr. Seale concerning the elimination of the Operational Safeguards Response Evaluations (OSREs). The Subcommittee recommended that a letter be drafted to the American Jewish Congress acknowledging receipt of its letter and stating that the Committee will work with the '
Commission as needed to resolve the issues.
o On December 1,1998, Dr. Larkins, ACRS/ACNW Executive Director met with NRC Chairman Shirley A. Jackson to discuss recent past and future activiSes of the ACRS and the ACNW. Matters related to the ACRS include: ACRS participation in the Quadripartite Meeting; ACRS reviews related to the Chairman's Tasking Memo; ACRS Reports on Research, past and future; Resolution of Generic Safety Issues; and the ACRS/ Commission Meeting in February 1999. In reference to the Quadripartite meeting, she asked a question related to the trip report on how other countries were addressing certain technicalissues, aside from the use of risk-informed decision making.
During tlee discussion of the other topics, Chairman Jackson raised questions on the timeliness of ACRS comments on her tasking j memorandum; assessment of the staffs progress on 50.59 revisions j and making 10 CFR Part 50 more risk-informed. She also briefly i discussed progress on developing a definition of safety. She stated I that it would be useful for the Commission to have Committee insights on the proposed changes to the assessment process and inspec';)n program, prior to the Congressional hearing in January. She noted that this would be useful, both as a reassurance for the Commission and for Congress, to know the ACRS was a viable part of the regulatory process.
o On November 10,1998, the President signed the Federal Reports Elimination Act of 1998, which arnends the Atomic Energy Act by eliminating the requirement that the ACRS submit an annual report to '
Congress on the Reactor Safety Research Program.
