UtKilfl[IT MINUTES OF THE FOUR HUNDRED FORTY-EIGHTH MEETING OF THE ADVISORY COMMITTEE ON REACTOR SAFEGUARDS FEBRUARY 5-7,1998 ROCKVILLE, MARYLAND The 448th meeting of the Advisory Committee on Reactor Safeguards was held at Conference Room 2B3, Two White Flint North Building, Rockville, Maryland, on February 5-7,1998. The purpose of this meeting was to discuss and take appropriate action on the items listed in the attached agenda. The meeting was open to public attendance. There were no written statements nor requests for time to make oral statements from members of the public regarding the meeting.

CHAIRMAN'S REPORT (Open)

Dr. Robert L. Seale, Committee Chairman,.onvened the meeting at 8:30 a.m. and reviewed the schedule for the meeting. He announced that Dr. Graham Wallis 1

would be attending this meeting as a Member for the first time, and that there were several interesting documents in the items of Current Interest package.

II.

STATUS OF DEVELOPING A REVISED FIRE PROTECTION RULE (Open)

The Committee heard a report by Dr. Dana A. Powers, Chairman of the Fire

Protection Subcommittee, regarding the meeting held on January 22,1998, to discuss the staff actions related to the development of a revised fire protection rule.

The Subcommittee received briefings from the representatives of the Office of Nuclear Reactor Regulation (NRR), the Office of Nuclear Regulatory Research

February 5-7,1998 (RES), Nuclear Energy Institute (aEI), National Fire Protection Association (NFPA),

the Union of Concemed Scientists (UCS), and the Nuclear Information & Resource Service (NIRS). Dr. Powers summarized the results of the Subcommittee meeting.

The NRR staff proposed three options: (1) develop a new risk-informed, performance-based rule that addresses shutdown as well as normal operations, (2) develop comprehensive guidance for the existing rule; and (3) maintain the status quo.

The RES staff provided the review process and completion schedule of the Individual Plant Examination of Extemal Events (IPEEE) submittals. The staff has received 69 submittals out of 74. The staff has completed a preliminary review of 57 submittals and concluded that the IPEEE program was generally successful in meeting the intent of Supplement 4 to GL 88-20. The staff also concluded that more specific and detailed reviews may be needed to apply information from IPEEEs to support risk-informed, performance-based regulation.

NEl expressed concern that the new rule is not needed, nor is it necessary to assure or improve safety. However, if the NRC proceeds with rulemaking, the industry plans to participate in the rulemaking process.

NFPA is developing a performance-based fire protection standard for nuclear facilities and the draft rule is scheduled to be issued in September 1998. The UCS and NIRS representatives stated that the NRC staff has not demonstrated a complete and adequate understanding of the formulation of the current regulation, particularly in regard to the development of the noncombustibility standard for fire barrier penetration seals which the NRC staff currently recommends be eliminated from the existing rule and from all other guidance documents.

Conclusion The Cornmittee plans to review this matter during its March 2-4,1998 meeting.

AP600 TEST AND ANALYSIS PROGRAM AND STANDARD SAFETY ANALYSIS REPORT (Open)

Mr. John Barton, Chairnwi of the Advanced Reactor Designs Subcommittee, noted that the Subcommittee met on February 3-4,1998, to gather information on the Test

and Analysis Program and eight chapters of the AP600 Standard Safety Analysis Report (SSAR). He noted that the ACRS members attending this full Committee session also attended the Subcommittee meeting.

Westinahouse Presentation Messrs. Brian McIntyre and Ron Vijuk, Westinghouse Electric Company, presented an overview of the following SSAR chapters:

Chapter 1: Introduction Chapter 4: Reactor Chapter 5: Reactor Coolant System and Connected Systems Chapter 7: Instrumentation and Control Chapter 8: Electrical Power Chapter 11: Radioactive Waste Management Chapter 13: Conduct of Operations Chapter 18: Human Factors Engineering The Committee Members, NRC staff, and representatives of We.stinghouse discussed the diverse actuation system and its association with the monitor bus and the schedule for issuing the next revision to the SSAR.

Mr. McIntyre presented the Test and Analysis Program objectives and summarized the tests that have been completed. He stated that the Westinghouse response to the remaining open items would be completed in February 1998.

NRC Staff Presentation Mr. Thomas Kenyon, NRR, stated that the staff has no open items on the nine chapters presented by Westinghouse. He presented the proposed schedule for the staff review of the AP600 design and provided a status of the open items.

Mr. William Huffman, NRR, presented the key open issues associated with the NOTRUMP and WGOTHIC codes, the automatic depressurization test program, and the scaling and the Phenomena identification and Ranking Tables related to the Oregon State University Test Program. He stated that the staff expected to receive responses from Westinghouse regarding the open issues no later than March 1, 1998.

Conclusion The Committee issued a letter to the Executive Director for Operations, dated February 19,1998, on this matter.

IV.

MEETING WITH CHAIRMAN JACKSON (Open)

Chairman Jackson met with the ACRS to discuss the NRC research program, the Human Performance and Reliability Plan, applications of risk-informed regulations, proposed revisions to 10 CFR 50.59, the relationship between the maintenance rule and shutdown risk, proposed changes to the fire protection regulations, and elevation of core damage frequency to a fundamental Safety Goal.

The Chairman mentioned the improved quality and timeliness of ACRS reports and expressed appreciation for the early involvement of the Committee in certain issues.

The Comrnittee described the areas where it has been proactive and enumerated its priorities for the next two years. Chairman Jackson stated that the ACRS

. priorities were consistent with the Commission's priorities.

V.

WESTINGHOUSE SPENT FUEL RACK CRITICALITY ANALYSIS METHODOL-

Dr. Thomas Kress, Chairman of the Regulatory Policies and Practices Subcommit-tee, noted that since a waste repository will not be available soon, it is important that industry make effective use of spent fuel pools to store and cool spent fuel. He explained that because of the need for spent fuel storage and the recent findings of degraded Boraflex in some spent fuel pool racks, Westinghouse developed and the staff approved the use of an analysis methodology that allows credit for spent fuel pool dissolved boron in reactivity calculations. Dr. Kress stated that the presentation was for information only.

Dr. Sushil Kapil, Westinghouse Electric Company, explained the different neutron absorbers used in spent fuel pools and the analytical methods used for determining the maximum storage capacity of the pools based on criticality considerations. He presented an overview of the Westinghouse methodology for crediting soluble boron

in criticality calculations. Dr. Kapil presented the approach and process used to determine the total boron concentration that would meet technical specification recommendations. He stated that the Westinghouse methodology increases fuel rack enrichment limits for storage of fresh fuel assemblies, relaxes checkerboard restrictions, and enhances the storage capacity of the fuel racks.

The Committee Members and representatives of the NRC staff and Westinghouse discussed the percentage change in fuel pool storage capacity due to Boraflex

degradation, the form of boron in solution, boron dilution accidents, the average dose rate in the spent fuel pool, changes in the source term as more fuel with higher enrichments are placed in the pool, and the need for additional reactivity monitors.

VI.

PROPOSED IMPROVEMENTS TO THE SENIOR MANAGEMENT MEETING PROCESS (Open)

Mr. John Barton, Chairman oithe Subcommittee on Plant Operations, introduced the topic to the Committee. He noted that the Subcommittee had discussed proposed improvements to the Senior Management Meeting (SMM) process with the staff and the Nuclear Energy Institute (NEI) on February 3,1998. He stated that it appeared that th1 staff had been responsive in addressing the questions of the Subcommittee based on his quick review of the handouts for this meeting. Mr.

Barton did, however, note that the staff had not provided its draft Commission paper on the integrated review of NRC assessment programs. He suggested that it would be premature for the Committee to prepare a repod to the Commission without the benefit of the subject document. He also stated that the Committee needs to meet with the staff again when the subject document is available and that the Committee plans to prepare a report at that time.

MRC Staff Presentation Messrs. Michael Jchnson, NRR, and Richard Barrett, AEOD, led the discussions for the NRC staff. Messrs. Frank Gillespie and William Borchardt, NRR, and William Raughley, AEOD, provided supporting discussion. Significant points made during the discussion include:

Specific SMM objectives include early waming of declining licensee j

performance, integration of inspection findings and other assessments, the focus of oversight and attention on issues important to risk, effective communication of results to licensees and the public, and allowance for agency planning and allocation of resources.

Process attributes include the use of a decision model with clearly defined roles and responsibilities; data that is consistent, timely, and scrutable;

identification of risk significance; and development of success criteria that are leading or predictive in identifying declining performance.

1 A single, integrated assessment process is proposed to replace the current J

SMM process, Systematic Assessment of Licensee Performance (SALP),

Plant Peiformance Reviews (PPRs), and Plant lasues Matrix (PIMs) using risk-graded inputs to the assessment template.

Annual regional assessment meetings will screen licensee performance and recommend action to the headquarters staff based on comparing plant / licensee performance with the decision logic model, Performance trend plots were developed and tested at the January 1998 SMR Finanvial indicators have been identified and used at the screening meetings.

The proposed template will be used on a pilot basis during the July 1998 SMM cycle.

The staff is continuing to evaluate the use of INPO/WANO indicators, the use of thresholds versus industry averages for trend plots, and methods for assessing management effectiveness.

NEl Presentation Mr. Steve Floyd, NEl, provided a brief discussion of the NRC assessment process.

d Significant points made during the discussion include:

I The proposed NRC process may result in some improvement in efficiency.

e However, NEl contends that the proposed improvements appear to be a repackaging of the current process and that the effectiveness of improve-ment is not yet evident.'

The criteria for assessment color codes (i.e., white, yellow, red) is not defined.

Use of industry average data continues to be a problem because overall industry performance continues to improve.

NEl questions whether economic data are a " leading" indicator of perfor-mance and if they are useful for indicating safety performance.

NEl contends that assessing management effectiveness has no regulatory basis and should not be done.

Drs. Powers and Apostolakis stated that the staff had been responsive to Subcommittee comments in providing its list of needs and objectives for the integrated assessment program. However, Dr. Apostolakis stated that there was a need for second-tier objectives and possibly a master logie diagram. The staff stated that the template defines the safety measures for the decision model.

Dr. Apostolakis noted that the staff had set criteria at a fairly low level and suggested that a higher level might be appropriate or that a more optimum level might be achieved. Dr. Apostolakis stated that performance-based regulation would suggest that the level be higher. He noted that the criteria proposed by NEl are higher and suggested that the appropriate level is somewhere in the middle. Dr.

Apostolakis also suggested that the right level is more likely to be achieved if the i

approach is risk-informed. The staff agreed that the measures were at a low level j

_.'but noted that the proposed criteria were suitable for evaluation through the inspection process.

Dr. Wallis requested a copy of the Facilitator's report to the SMM Task Force to better understand what the proposed improvements were intended to fix. The staff

- agreed to provide this report to the Committee.

February 5-7,1998 The Committee and staff extensively discussed the assessment of management effectiveness. The staff stated that the Arthur Andersen report had suggested that probleme in the area of management effectiveness was a leading indicator of declining performance. Dr. Seale noted that the Towers-Perrin report had objected to the NRC's past assessment of management effectiveness. Dr. Powers stated that the staff should evaluate safety performance and not management measures.

Dr. Apostolakis requested a copy of NEl 96-04 regarding organizational perfor-mance. NEl representatives agreed to provide the subject document.

At the conclusion of the meeting, Mr. Barton requested the staff to brief the Committee during its March 2-4,1998 meeting. He requested the staff to provide its Commission paper on the integrated assessment program and requested the staff to also discuss the template and guidance for the use of economic indicators.

Conclusion The Committee plans to prepare a report to the Commission during the March 2-4, 1998 ACRS meeting.

PROPOSED REVISION TO 10 CFR 50.59. " CHANGES. TESTS AND EXPERI-MENTS"(Open)

Mr. John Barton, Chairman of the Subcommittee on Plant Operations, introduced the topic to the Committee. He stated that the Committee has had a longstanding interest in the proposed changes to 10 CFR 50.59 (Changes, Tests and Experi-ments). He noted that the Committee had previously met in April, October, and December 1997 regarding these matters. He also noted that the Committee had met with NEl representatives to discuss attemate rule language proposed by the industry.

Mr. Barton suminarized the ACRS report dated December 12,1997, and noted that the NRC Executive D! rector for Operations (EDO) had responded in a letter dated January 8,1998. He stated that the staff was waiting for guidance from the Commission and that the purpose of this meeting was for the staff to provide a status update.

NRC Staff Presentation Ms. Eileen McKenna, NRR, led the discussion for the NRC staff. Mr. Jack Roe, NRR, also participated. The staff discussed the current status of activities related to rulemaking for 10 CFR 50.59, staff review of NEl 96-07, and other related activities. Significant points made during the discussion include:

The staff concluded that NEl 96-07 is inconsistent with the current rule on 10 CFR 50.59, needs clarification in other areas, and could result in enforce-ment action if implemented by the industry.-

The staff has fonned a senior-level panel to screen all potential violations of 10 CFR 50.59 to ensure consistency in the implementation of the NRC enforcement policy.

Other related activities include possible endorsement of NEl 98-03 related to Final Safety Analysis Reports and NEl 97-04 related to plant design bases.

Dr. Powers questioned whether or not the staff was actively developing a paper to I

address possible risk-informed changes under 10 CFR 50.59. The staff stated that it was not because the current two-step proposal for rulemaking would defer risk-informed initiatives, Dr. Powers suggested that the staff should consider developing a contingency plan to consider how it might be done if the Commission supports incorporation of the risk-informed approach in the phase one sequence. The staff j

stated that it was not altogether sure that it wanted to pursue risk-informed initiatives at the 10 CFR 50.59 level.

The Committee and staff extensively discussed er.forcement for 10 CFR 50.59.

Drs. Seale and Miller questioned the number and significance of 10 CFR 50.59 enforcement actions., The staff stated that its tracking system lists only escalated enforcement actions and that the total number varies from 1-10 escalated actions per year. Dr. Miller noted that this was about 0.1% of e!! enforcement actions and

- questioned the significance that would warrant rulemaking.

At the conclusion of the meeting, Mr. Barton stated that the 10 CFR 50.59 process needs to be stabilized. He added that the current process appears to work well and may not, in fact, be broken. He stated that the Committee may wish to clarify the timing and magnitude of the move toward risk-informed, performance-based regulation in its r.axt letter to the Commission related to 10 CFR 50.59,.

SECY-97-231. PERFORMANCE-BASED INSPECTION GUIDANCE (Open)

Dr. George Apostolakis, Chairman of the Subcommittee on Reliability and Probabilistic Risk Assessment (RPRA), introduced the topic to the Committee. He noted that the title of SECY-97-231, " Performance-Based inspection Guidance and the Distinction between inspecting for Performance and Inspecting Against a Performance-Gased Rule," was intriguing and requested the staff to enlighten the Committee on the distinction between the two issues.

Dr. Apostolakis also noted that the staffis preparing a policy paper on the larger issue of performance-based regulation and that the Commission staff is preparing a " white paper" on the subject.

NRC Staff Presentation Messrs. Ronald Frahm, Jr., and Frank Gillespie, NRR, led the discussion for the NRC staff. Messrs. William Borchardt and Douglas Coe, NRR, provided supporting discussion. The staff provided a brief discussion of the history of the inspection q

program, described the current inspection program, and reviewed performance-(

based inspection concepts and training for inspectors. Significant points made l

during the discussion include:

Performance-based inspection focuses on issues of safety and reliability with emphasis'on observation rather than in-office procedural record reviews.

Inspections start by observing work activities, then discrepancies or uncertainties lead to inspection in other areas.

Performance-based regulation provides licensees with greater flexibility in

. developing and adjusting program implementation to efficiently utilize resources in managing activities and programs (i.e.,10 CFR 50.65, the Maintenance Rule).

448th ACRS Meeting 11 February 5-7,1998 Formal training has been conducted to communicate management expectations and consistency in implementation. Additional improvements and training are planned.

The Committee and staff extensively discussed the role of resident inspectors and onsite inspection practices at licensee facilities. Dr. Seale requested copies of the latest version of the " Inspecting for Performance" training manual. Dr. Seale also requested that copies of future issues of the Inspection Program Newsletter be provided to the Committee. The staff agreed to provide copies of the subject documents.

Dr. Apostolakis questioned the staffs view of what constitutes performance-based regulation. He noted that the Office of the inspector General report had concluded that the Maintenance Rule was not performance-based. The staff stated that some portions of 10 CFR 50, Appendix B, may need to be revisited because of possible overlap with the requirements of the Maintenance Rule.

At the conclusion of the meeting, Dr. Apostolakis informed the staff that the Committee planned to prepare a report to the Commission on performance-based regulation during a future meeting. He reiterated that the staff was preparing a draft policy paper to the Commission and that Chairman Jackson's staff was preparing a " white paper" on the subject.

Conclusion The Committee decided to continue its review of these matters during future meetings.

IX.

HUMAN PERFORMANCE AND RELIABILITY IMPLEMENTATION PLAN (Open)

Dr. George Apostolakis, Chairman of the Human Factors Subcommittee, provided a summary report of the January 21,1998 Subcommittee meeting. He described the following four presentations that the staff made to the Subcommittee: 1) the status of revising the Human Performance and Reliability Plan,2) the status of the pilot demonstration of a technique for human error analysis (ATHEANA),3) the use of human factor insights in developing the inspection program, and 4) uses of the Office for Analysis and Evaluation of Operational Data human performance event database.

448th ACRS Meeting 12 February 5-7,1998 Dr. Apostolakis noted that the ACRS invited experts presented their views on human risk assessment model development and that Committee Members

~ discussed the statements by the invited experts that probabilistic risk assessments (PRAs) overweigh the risk of human performance.

Dr. Apostolakis stated that the Subcommittee requested the opportunity to review the Human Performance and Reliability Plan prior to the scheduled NRC Chairman's briefing. Some Committee Members plan to attend the peer review training session on ATHEANA. He noted that the Subcommittee agreed that the Office of Nuclear Materials Safety and Safeguards was not strong in the human performance area.

Dr. Julius Persensky, RES, presented the staffs proposed schedule for future meetings with the Human Factors Subcommittee and the full Committee.

Conclusion This briefing was for information only, No Committee action was required.

Report on the Meeting of the Planning and Procedures Subcommittee (Open)

The Committee heard a report from Dr. Seale and the Executive Director, ACRS, on the Planning and Procedures Subcommittee meeting held on February 4,1998. The following items were discussed:

1.

COMMISSION MEETING WITH ACRS The Commission meeting with the ACRS has been moved to April 2, 1998 to accommodate the Chairman's schedule. In the next few weeks, the ACRS staff will fonnard proposed items for discussion to the Commission. This will allow time for their response and for the ACRS staff to prepare summary papers and viewgraphs. Proposed items include:

- NRC Safety Research Program

- Risk-informed, performance-based regulation, including use of PRA in the regulatory decisionmaking process

- Proposed revisions to 10 CFR 50.59 process

- Shutdown and low-power operation

- Ststus of AP-600 review

- Senior Management Meeting process

- Timeliness and utility of ACRS advice

- ACRS priorities for FY 98 and 99 RECOMMENDATION The Subcommittee recommended that, once topics have been approved by the Commission, those topics be delegated to Commit-tee Members who will ensure that papers and viewgraphs are prepared well before the deadline of one week before the Commis-sion meeting. Members should also be prepared to discuss other topics that might be raised at this meeting.

PREPARATION OF MEETING MINUTES During the retreat, ACRS Members recommended that Full Commit-tee Minutes should be used as a tracking document for Committee performance and should meet, but not exceed, FACA requirements, which call for the Minutes to contain a " complete and accurate description of matters discussed and conclusions reached." Since a transcript is available for all Full Committee meetings, the word

" complete" is interpreted to mean that Minutes will include a brief listing of all topics covered but that they should focus on advice given and actions agreed upon. This should reduce the preparation time for the Minutes. The content of Subcommittee Minutes has also been revised along these same lines. Subcommittee Chairmen should provide feedback on the revised Subcommittee Minutes to the cognizant Staff Engineer or the Executive Director.

RECOMMENDATION The Subcommittee recommended that the revised format for Full Committee Minutes be adopted and that Subcommittee Minutes be reviewed after further experience has been gained with the new i

format.

3.

NEW MEMBERS The new member solicitation for a candidate with Plant Opera-tion /PRA experience has been approved by the Commission with some minor word changes, and the Federal Register Notice and Press Release have a closing date of mid-March 1998. The Office of Human Resources has been requested to place advertisements announcing the vacancy in several trade magazines.

INTERNATIONAL MEETINGS JADAQ The date for the Quadripartite Meeting is set for October 5-9,1998.

A proposed agenda was also received (pp.1-2). The Committee should review and comment on the agenda, decide which members should attend this meeting, and set deadlines for the preparation of papers.

16 February 5-7,1998 United Kinadom A letter has been written to the Nuclear Safety Advisory Committee (NUSAC) of the United Kingdom, suggesting that a meeting take place in the late spring-early summer between the two Committees.

The NUSAC meets 3 times a year. The Committee should decide on agenda items and selection of members to attend this meeting.

The Committee recommended that the agenda for the Quadripartite Meeting include a session on Thursday aftemoon on human perfor-mance. Drs. Kress and Apostolakis indicated that they would not attend the site visit during the meeting in Japan.

5.

ACRS RETREAT Priority issues were determined for the 1998-1999 fiscal years. These are reflected in a new Operating Plan. Distribution of responsibility for these Priority issues should be reviewed to prevent an undue burden on Members.

RECOMMENDATION The Subcommittee recommended that the Operating Plan be discussed further during the 448th meeting and that responsibility for Priority Issues be distributed among Members to avoid undue burden.

Dr. Apostolakis mentioned the need for prior review of Sub-committee meeting agendas to ensure that the staff would be prepared to discuss the items on the agenda and to cance! a meeting if this were noi the case. The Executive Director agreed to review the list of Subcommittee meetings with the Senior Staff Engineers on a regular basis to determine if the meetings should be scheduled based on the availability of review materials and readiness of the staff.
