The New York ,wer Authority requests an amendment to the Technical Specifications contained in Appendix A to Facility Operating License DPR-59 for the James A. FitzPatrick Nuclear Power Plant. This application is filed in - l~

accordance with Section 10 CFR 50.90 of the Nuclear Regulatory Commission's regulations.

This application for an Amendment to the James A. FitzPatrick Technical Specifications proposes to revise Emergency Service Water System (ESWS) pump Surveillance Requirement 4.11.D.1. The proposed change addresses  ;

the limitations of the " shut off head" ESW pump surveillance test currently '!

required by the FitzPatrick Technical Specifications. The proposed  ;

surveillance test would add a flow requirement and test the pump in '

accordance with the FitzPatrick Inservice Testing Program which is designed . ,

to address appropriate portions of Section XI of the American Society of i Mechanical Engineers (ASME) Boiler and Pressure Vessel (B&PV) Code. To i add operational flexibility, the Authority has also revised pump flow rate l requirements based on changes to the system alignment, revised heat load i calculations and revised component flow requirements.

This submittal satisfies a commitment to improve the ESW pump  !

surveillance test.

The proposed change to the Technical Specifications is Attachment I to this -
