APPLICATION FOR AMENDMENT TO OPERATING LICENSE The New York Power Authority requests an amendment to the Technical Specifications contained in Appendix A to Facility Operating License DPR 59 for the James A.

FitzPatrick Nuclear Power Plant. This application is filed in accordance with Section 10 CFR 50.90 of the Nuclear Regulatory Commission's regulations.

This application for an amendment to the James A. FitzPatrick Technical l Specifications (TS) proposes to incorporate the inservice testing requirements of Section XI of the Amencan Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel (B&PV) Code. The proposed change adds a new surveillance requirement,4.0.E, which refers to the requirements of Section XI of the ASME B&PV Code and Addenda established by 10 CFR 50.55a(f). Ancillary changes are also required since the proposed Specification 4.0.E replaces the surveillance testing requirements of safety related pump and rnotor operated valves and extends the surveillance testing frequency of other components from once every month, to coincide with the ASME Section XI requirements.

l l Quarterly pump and valve testing is required by the 1980 Edition of the ASME Code and the applicable sections of 10 CFR 50.55a. These changes will result in an appropriate test interval for assuring component operability, will not significantly impact system reliability, and make the FitzPatrick Technical Specifications more consistent with the Standard Technical Specifications.

Editorial changes have been made on the pages being revised by the incorporation of ASME Section XI. These changes include correction of typographical / punctuation errors, editorial clarifications, and the deletion of blank

pages.

The proposed changes to the Technical Specifications are Attachment I to this Application for Amendment to the Operating License. The Safety Evaluation for the proposed change is included as Attachment II. A markup of the affected Technical l Specification pages in included as Attachment 111.
