APPLICATION FOR AMENDMENT TO OPERATING LICENSE The New York Power Authority requests an amendment to the Technical Specifications contained in Appendix A to Facility Operating License DPR-59 for the James A. FitzPatrick Nuclear Power Plant. This application is filed in accordance with Section 10 CFR 50.90 of the Nuclear Regulatory Commission's regulations. .

This application for an amendment to the James A. FitzPatrick Technical Specifications revises Specification 4.6.E.4 regarding manual testing of the Reactor Coolant System (RCS) safety / relief valves. The amendment proposes to revise the surveillance requirement, so that the time allowed for testing does not start before the conditions necessary for these tests exist.

A recent amendment added a 12 hour1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> time limit for completing the manual cycling of RCS safety / relief valves during plant startups, based on Standard Technical Specifications. The 4 only test condition currently specified is that RCS pressure must be at least 940 psig.

Sufficient steam flow, in addition to minimum pressure, is needed to perform this test. The revised specification makes it clear that the 12 hour1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> limit does not begin until after the prerequisite test conditions have been established.

Editorial changes to clarify the intent of specifications involving safety / relief valve testing and performance requirements are also proposed.

Attachments I,11, and 111 to this application contain the proposed changes to the Technical Specifications, the associated Safety Evaluation, and a mark-up of the current Technical Specification pages, respectively.
