i APPLICATION FOR AMENDMENT TO OPERATING LICENSE 1
The New York Power Authority requests an amendment to the Technical Specifications contained in Appendix A to Facility Operating License DPR-59 for the James A. FitzPatrick Nuclear Power Plant. This application is filed in accordance with Section 10 CFR 50.90 of the Nuclear Regulatory Commission's regulations.

This application for an amendment to the James A. FitzPatrick Technical Specifications (TS) proposes to allow reactor coolant system pressure tests to be performed while remaining in l
the Cold Shutdown Mode. Primary containment integrity is not required in the Cold Shutdown l
Mode thus allowing unrestricted access to the primary containment for the performance of j
inspections. The changes will also allow outage activities on other systems to continue. The j
changes, with minor exceptions, adopt Special Operations Section 3.10.1, " Inservice Leak and j
Hydrostatic Testing Operation," from Standard Technical Specifications (STS), NUREG-1433.
Minor exceptions are required to ensure consistency within FitzPatrick TS, reflect differences l
between FitzPatrick TS and STS, and ensure the same level of ECCS redundancy afforded by STS during pressure testing. These exceptions will be eliminated when the FitzPatrick TS are i
converted to STS.
Editorial changes to improve the table of contents, relocate text, use consistent terminology, and reflect the addition of new TS pages are also proposed.
l Attachment I contains the proposed new Technical Specification pages and Attachment 11 is the Safety Evaluation for the proposed changes. Attachment lll is a markup of the affected pages.
