On March 20, 2023, a partially closed Observation meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Holtec Decommissioning International, LLC (the licensee) at 11555 Rockville Pike, Rockville, MD. The purpose of the meeting was to discuss the licensees regulatory path to potentially request reauthorization of power operations at Palisades Nuclear Plant, based on its {{letter dated|date=February 1, 2023|text=February 1, 2023, letter}}, which was mostly proprietary.
On March 13, 2023, the licensee submitted a revised letter where most of the information previously marked as proprietary, was no longer redacted. The meeting notice and agenda, dated March 6, 2023, is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML23079A0 53. A list of attendees is provided as an Enclosure.

The licensees slide presentation for the public portion of the meeting is available in ADAMS at Accession No. ML23075A112. The licensees revised {{letter dated|date=March 13, 2023|text=March 13, 2023, letter}} is available in ADAMS at Accession No. ML23072A404. The licensee began the presentation with some background information such as a brief timeline on recent plant milestones and moved on to describing the current status of the plant. Based on a question from the NRC staff, the licensee clarified that while some work has occurred since the plant shut down, no major decommissioning activities have occurred. The licensee then provided an overview of their plan to potentially request reauthorization of power operations at Palisades. The licensee stated that the plan would be to submit a request for an exemption to the requirements of Title 10 of the Code of Federal Regulations (10 CFR) 50.82(a)(2) which states that the license no longer authorizes operation of the reactor or retention of fuel in the reactor vessel. Following the exemption request, the licensee stated that a se ries of license amendment requests would be submitted to restore the Palisades operating licensing basis to that which existed just prior to the plant shutting down. The NRC staff asked what the licensees envi ronmental considerations would be for these licensing actions. The licensee stated that they believed these licensing actions would meeting the categorical exclusion requirements of 10 CFR 51.22. SUMMARY

OF MARCH 20, 2023, MEETING WITH HOLTEC DECOMMISSIONING INTERNATIONAL, LLC REGARDING REGULATORY PATH FOR POTENTIALLY REQUESTING REAUTHORIZATION OF POWER OPERATIONS AT PALISADES NUCLEAR PLANT

On March 20, 2023, a partially closed Observation meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Holtec Decommissioning International, LLC (the licensee) at 11555 Rockville Pike, Rockville, MD. The purpose of the meeting was to discuss the licensees regulatory path to potentially request reauthorization of power operations at Palisades Nuclear Plant, based on its February 1, 2023, letter, which was mostly proprietary.

On March 13, 2023, the licensee submitted a revised letter where most of the information previously marked as proprietary, was no longer redacted. The meeting notice and agenda, dated March 6, 2023, is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML23079A0 53. A list of attendees is provided as an Enclosure.

The licensees slide presentation for the public portion of the meeting is available in ADAMS at Accession No. ML23075A112. The licensees revised March 13, 2023, letter is available in ADAMS at Accession No. ML23072A404. The licensee began the presentation with some background information such as a brief timeline on recent plant milestones and moved on to describing the current status of the plant. Based on a question from the NRC staff, the licensee clarified that while some work has occurred since the plant shut down, no major decommissioning activities have occurred. The licensee then provided an overview of their plan to potentially request reauthorization of power operations at Palisades. The licensee stated that the plan would be to submit a request for an exemption to the requirements of Title 10 of the Code of Federal Regulations (10 CFR) 50.82(a)(2) which states that the license no longer authorizes operation of the reactor or retention of fuel in the reactor vessel. Following the exemption request, the licensee stated that a se ries of license amendment requests would be submitted to restore the Palisades operating licensing basis to that which existed just prior to the plant shutting down. The NRC staff asked what the licensees envi ronmental considerations would be for these licensing actions. The licensee stated that they believed these licensing actions would meeting the categorical exclusion requirements of 10 CFR 51.22. The licensee then talked about ensuring systems, struct ures, and components would be able to support technical specification operability and operating license basis through a return-to-service plan.

The NRC staff asked if the licensee planned on submitting this plan to the NRC for review and approval. The licensee said they had not planned on submitting it but was open to more discussion on the topic in the future. The remainder of the licensees plan included rescinding of

decommissioning orders, re-evaluating orders and industry initiatives that were no longer applicable once the plant shut down and having the Defueled Safety Analysis Report restored to the Updated Final Safety Analysis Report. The lic ensee stated that securing funding from the Department of Energy and the State of Michigan, as well as securing a power purchase agreement, were all key drivers on whether the licensee will decide to move forward with requesting reauthorization of power operations at Palisades. The licensee said they hope to make the decision later this year.

The remainder of the meeting was closed to the public.

Members of the public were in attendance and a some of them had comments for the NRC staff.

There were some comments in favor the licensee moving forward with the project for reasons related to providing local jobs, tax revenue, and a clean energy source. Others were against the licensee moving forward with the project for reasons as it being too risky and too old, concerns about possibly improper use of decommission funding, questioning the use of the previous licensing basis, tritium contamination, loss of experienced staff, overall cost, and vessel integrity.
