SUMMARY
OF NOVEMBER 27, 2017, PUBLIC MEETING WITH ENTERGY NUCLEAR OPERATIONS, INC. REGARDING REQUEST TO EXTEND ENFORCEMENT DISCRETION FOR TORNADO MISSILE NONCONFORMANCES (EPID: L-2017-LRM-0054)
On November 27, 2017, a Category 1 public teleconference meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Entergy Nuclear Operations, Inc. (ENO, the licensee). The purpose of the meeting was to discuss a proposed request to extend the enforcement discretion for tornado-generated missile noncompliances for Palisades Nuclear Plant (PNP).

Enforcement Guidance Memorandum (EGM) 2015-002, "Enforcement Discretion for Tornado-Generated Missile Protection Noncompliance" (Agencywide Documents Access and Management System (ADAMS) Accession No. ML15111A269) and EGM 2015-002, Revision 1 (ADAMS Accession No. ML16355A286), provide guidance to exercise enforcement discretion for tornado-generated missile protection noncompliances. The EGMs identified PNP as a higher tornado missile risk site, resulting in an enforcement discretion expiration date of June 10, 2018. As described in EGM 15-002, Revision 1, a licensee may request an extension to their enforcement discretion expiration date if proper justification is provided. This extension will be evaluated by the NRC on a case-by-case basis.
The licensee presented the current licensing basis for PNP's tornado protection design and their assessment of nonconforming conditions. The assessments identified six nonconforming conditions which were documented in condition reports. The affected systems include: the service water system, the fuel oil transfer system, the emergency diesel generator support systems, the control room heating, ventilation and air condition intake, the auxiliary feedwater system steam supply, and the component cooling water surge tank. The licensee explained that they followed the guidance in EGM 15-002 and Interim Staff Guidance DSS-ISG-2016-01, "Clarification of Licensee Actions in Recepit of Enforcement Discretion per Enforcement Guidance Memorandum EGM 15-002, Enforcement Discretion for Tornado-Generated Missile Protection Noncompliance" (ADAMS Accession No. ML15348A202), following discovery of the nonconformances. These actions included, in part, performance of operability determinations and institution of compensatory measures. The licensee also detailed the long-term compensatory measures that will remain in place until the nonconformances are resolved.
The licensee plans to submit a request for an extension of enforcement discretion to allow time to resolve the tornado missile protection nonconformances and restore compliance. The licensee plans to submit a risk-informed license amendment request for use of the Tornado Missile Risk Evaluator (TMRE) methodology to evaluate the identified nonconformances. This methodology is currently in development by the industry and several pilot sites have submitted license amendment requests (LARs) using the TMRE methodology. The licensee plans to submit their LAR after the NRC has evaluated the pilot site's submittals and to request to extend the enforcement discretion from June 10, 2018, to June 10, 2020. The extension request is expected within several weeks of the public teleconference.
During the teleconference, the NRC staff noted that details regarding the compensatory measures and a detailed timeline including the necessary licensee's actions to warrant an extension to the enforcement discretion should be included.
The public was invited to listen to the meeting and was given an opportunity to communicate with the NRC after the business portion, but before the meeting was adjourned. Members of the public were present and provided comments to the NRC staff.
No regulatory decisions or commitments were made during the meeting. No public meeting feedback forms were received.
