SUMMARY

OF DECEMBER 5, 2023, MEETING WITH HOLTEC DECOMMISSIONING INTERNATIONAL, LLC REGARDING POWER OPERATIONS TECHNICAL SPECIFICATIONS On December 5, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff held an open hybrid meeting with representatives of Holtec Decommissioning International, LLC (Holtec, the licensee) at 11555 Rockville Pike, Rockville, Maryland. NRC staff, Holtec representatives, and members of the public also participated remotely via Microsoft Teams. The purpose of this meeting was for the NRC staff and Holtec representatives to discuss planned submittals for power operations technical specifications (TSs), in support of reauthorizing power operations at Palisades Nuclear Plant (PNP). Holtec plans to submit two separate TSs related license amendment requests (LARs). The planned LARs are power operations TSs and power operations administrative TSs as described in Holtecs presentation. The meeting notice and agenda dated November 20, 2023, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML23334A188. A list of attendees is provided as an enclosure. Holtecs presentation is available in ADAMS at Accession No. ML23334A132.

Holtec representatives began the presentation with an overview of the agenda, purpose, background, and general expected outcome for the meeting. For the background, Holtec emphasized that the PNP Renewed Facility Operating License (RFOL) remains active until March 2031. Holtec confirmed that it would be using revision 35 (ADAMS Accession No. ML21125A344) of the previously docketed power operations Updated Final Safety Analysis Report (UFSAR) for the planned TS related LAR submittals. Holtec also indicated that one of the reasons for the planned license amendment TS change is to support reinstatement of the PNP Power Operations Licensing Basis (POLB). Proposed changes to the PNP operating license, including RFOL, TS - Appendix A, and Environmental Protection Plan (EPP) -

Appendix B were also presented and discussed. Holtec representatives also discussed the approach for POLB, RFOL, and TS reinstatements, and highlighted some of the relevant TS sections.

Holtecs planned licensee actions to support POLB reinstatement are as follows:

Restore commitments closed based on decommissioning certification.

Restore UFSAR to reflect power operations plant.

Restore compliance to NRC Orders and industry initiatives.

Develop Return to Service Plans for Safety Related and Important to Safety Systems Structures and Components.

Restore Regulatory Programs and Operating Procedures (e.g., Quality Assurance (QA)

Program, Inservice Inspection Program, Emergency Operating Procedures).

Near-term schedule for future planned submittals discussed are as follows:

License transfer - December 2023 (Submitted December 6, 2023)

Power operations TS - December 2023 (Submitted December 14, 2023)

Power operations administrative TS - January 2024 Emergency plan - January to March 2024.

The NRC staff asked Holtec representatives about whether Holtec is planning on one or two separate TS submittals. Holtec representatives indicated that two separate TS submittals as shown on the planned submittal schedule.

The NRC staff also asked the representatives if they were planning to submit an operating plant QA program for NRC review and approval. The NRC staff also indicated that the QA program at Palisades during previous power operations could not be transferred from Entergy to Holtec.

Holtec representatives indicated that they did not think that approval was required. Both the NRC staff and Holtec representatives agreed to have a follow-up discussion on the QA program issue.

The NRC staff also asked about whether the planned license transfer and power operations planned submittal for December 2023 were still on track. Holtec indicated that submittal was imminent and on track for December. The license transfer and power operations TS were submitted on December 6 and 14, 2023 (ADAMS Accession Nos. ML23340A160 and ML23348A148), respectively.

There were also discussions on the plan to restore commitments for compliance with NRC orders and industry initiatives. Both the NRC staff and Holtec representatives agreed that additional discussions are needed to address the issue of compliance with NRC orders and industry initiatives.

There were several comments from members of the public during the public questions and comments portion of the meeting. There were some comments in favor of moving forward with the PNP restart project for reasons related to providing local jobs, tax revenue, climate goals, and a clean energy source. Other comments were against moving forward with the project for reasons such as it being too expensive for taxpayers, concerns regarding waste, risks associated with plant being too old, and public safety. No Public Meeting Feedback Forms were received.
