SUMMARY
OF SEPTEMBER 28, 2020, PUBLIC TELECONFERENCE WITH ENTERGY NUCLEAR OPERATIONS, INC. TO DISCUSS FUTURE REQUEST FOR A ONE-TIME EXEMPTION FROM CERTAIN REQUIREMENTS OF 10 CFR PART 50, APPENDIX E, SECTION IV.F AT PALISADES NUCLEAR PLANT (EPID L-2020-LRM-0091 [COVID-19])
On September 28, 2020, a Category 1 public teleconference was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Entergy Nuclear Operations, Inc. (Entergy, the licensee). The purpose of the teleconference was for NRC staff to discuss with Entergy its proposed request for a one-time exemption from the requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Appendix E, Biennial Emergency Preparedness (EP) exercise for Palisades Nuclear Plant (Palisades), due to the Coronavirus Disease-2019 (COVID-19) public health emergency (PHE). Specifically, the exemption request related to the requirements in 10 CFR Part 50, Appendix E, Section IV.F.2.c, for offsite response organization (ORO) participation in a biennial EP exercise for calendar year (CY) 2020. No regulatory decisions were made during the meeting. The meeting notice dated September 17, 2020, is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20271A001. Discussion During the meeting, the licensee provided a slide presentation on its proposed exemption request regarding the EP exercise exemption for Palisades. The licensee indicated that due to the COVID-19 PHE, the State of Michigan had requested postponement of ORO participation in the planned 2020 biennial EP exercise at Palisades. The licensee indicated that the biennial EP exercise is currently scheduled for October 27, 2020. Entergy indicated it planned to provide its proposed exemption request regarding the EP exercise on October 1, 2020, with a request for NRC staff approval by December 31, 2020. The licensee clarified that it will be conducting the onsite portion of the exercise by October 27, 2020, and the proposed exemption request is to exclude the offsite portion until CY 2022.
The NRC staff clarified the guidance for the licensee and staff review of the proposed exemption request. The NRC staff emphasized that the licensee should refer to NRC staffs guidance in the NRC letter to industry dated September 2, 2020 (ADAMS Accession No. ML20223A152),
which directly relates to the licensees proposed request. The NRC staff also mentioned that the recently issued Temporary Staff Guidance, TSG-NSIR-2020-01, dated September 11, 2020 (ADAMS Accession No. ML20196M030), contains templates and a road map for staff expectations and review of specific EP biennial exemptions, including for the licensees proposed request.
Representatives from Federal Emergency Management Agency, Michigan Department of Environment, Great Lakes, and Energy, Michigan State Police Emergency Management Homeland Security, and other members of the public were in attendance. No questions were received from the members of the public.
